Oil Royalty Warrants Review

Kota Kinabalu (20 November 2008): State Government has been urged to initiate a review of the 1976 Petroleum Agreement between the State and Federal Government with the view to revise the oil royalty from five percent to no less than 20 per cent.

Luyang Assemblywoman Melanie Chia, who relinguished her post as Assistant Finance Minister in September, said under normal circumstances of contract, 32 years is a long time.

“If we take the five year review period allowed under the Article 1120 of the Federal Constitution for the Special Grant, we could already have had six reviews,” she said.

“In the interest of Malaysians in Sabah, I urge the State Government to review and revise Sabah petroleum royalty to not less than 20 per cent.

“I seek the support from members of the House for the interest of the people in Sabah,” she said to thumping of tables by her two opposition colleagues, Datuk Liew Teck Chan (likas) and Jimmy Wong (Sri Tanjung).

At the same time, Chia asked who is representing Sabah in the National Petroleum Advisory Council as allowed under Section5 of the 1976 Petroleum Development Act.

She said in the 2009 Budget, revenue from the sales tax of crude palm oil and oil royalty totaling about RM1.5 billion represented 58 per cent of the State’s total revenue.

Any changes to the prices of these commodities would affect the revenue estimates for next year, she said, adding she wanted to know what is the revenue forecast formula and if there is any contingency plan to cushion any changes in the forecast.

Perhaps, she said, it would be an opportune time for the State government to review its sources of revenue, especially through the direct revenue and grants from the Federal Government.

She said the Special Grant given under Schedule 10 Part IV Section 2 (I) was reviewed by the Sabah Special Grant (first review) Order, 1970 and had since remained at RM26.7 million per year in 1973 until today.

“Although the Constitution allows a review every five years, it has not been done since 1973. It seems the formula for deriving the amount has also never been clearly spelt out”, she said.

Chia said since the formation of Malaysia, the Federal Government in exchange for development funds, had assumed the collection of income tax, customs duties, sales and services tax, stamp duty, road tax and others such as petroleum revenues, premium/bonuses in addition to royalties and licence fees.

She said the Special Grant stipulated under Schedule 10 Part IV Section (I) states that “in the case of Sabah, a grant of an amount equal in each year to two-fifths of the amount by which the net revenue by the Federation from the Sabah exceeds the net revenue which would have been derived in the year 1963…”.

“It seems there are many parameters here. Perhaps, the Government can enlighten us and hope the State Government will be able to get a very good revision to the RM26.7 million fixed since 1973,” she said.

Also, the revision should take into account the discrepancies in the State’s socio-economic status and higher cost of living, she added.

Chia said Malaysians in Sabah do not take note that Federal spending in Sabah had been increasing over the Malaysian Plans but it is also noted that the major portion of these allocations went to the operating costs of the Federal Departments and agencies in Sabah to the extent of more than 60 per cent.

She called on the State Government to inform the House on the total number of Federal departments and agencies in Sabah at this moment and their personnel as well as their annual operating costs.

Chia also raised the Kimanis-Bintulu gas pipeline project issue, saying she disagreed with the statement that sending the gas to Bintulu and using the rest of the supply to support the downstream industry at the petrochemical plant in Kimanis was the only practical approach.

Instead, she said the first thing that needed to be considered was the setting up of the petrochemical plant.

Meanwhile, Chia said the commotion involving the Queen Elizabeth Hospital (QEH), which is located within her constituency was saddening because the Government should have prioritized the interest and be sensitive to the needs of the people.

Based on the QEH Master Plan that began in 1995 and implemented in stages that was to be done in two phases up to 2010, it was planned in a way to give the hospital a prominent role in the 21st century.

“But the fact is the plan was implemented properly causing the healthcare service sector to be upside down,” she said, adding that the present scenario gave a negative impression on the quality of life in Sabah due to the failure of the Federal Government in fulfilling its responsibility.

ACA urged to probe RM10mil spending


Kuala Lumpur (Nov 20, 2008): A REPORT has been lodged with the Sabah Anti-Corruption Agency over the RM10mil allegedly spent by Barisan Nasional MPs for open houses and celebrations in their respective constituencies during festive seasons last year.

Datuk Eric Enchin Majimbun (SAPP – Sepanggar) said he had called Sabah ACA to investigate the matter.

“I might have attended some functions last year, which I did not know where the funding came from,” he said in a press statement yesterday.

He added that he would write a full report for the Prime Minister.

It was reported on Wednesday that 10 Barisan MPs had spent almost RM10mil of their special parliamentary allocation.

The Tenom constituency recorded the highest average per function at RM17,042 and the lowest was in Kuala Terengganu at RM3,018.

The 10 constituencies, which spent as much as RM900,000 each, were Tenom with 58 events followed by Dungun (87), Putatan (86), Tawau (66), Silam (40), Kuala Nerus (248), Sepanggar (54), Kuala Terengganu (304), Parit (137 ) and Marang (186).

Tan Kok Wai (DAP – Cheras) had asked the Prime Minister to state the cost and number of open houses organised by MPs during festive seasons such as Hari Raya, Chinese New Year, Deepavali, Gawai Dayak, Christmas, Good Friday, Wesak and for Merdeka celebrations.

Minister in the Prime Minister’s Department Datuk Mohd Johari Baharum had replied that 196 Barisan MPs had spent the special allocation on food, drinks, rental of tents and equipment, donations to the poor, orphans, the disabled and other related services.

Datuk Dr Chua Soon Bui (SAPP – Tawau) has clarified that she was not the MP last year. It was Shim Paw Fatt. Datuk Dr Marcus Makin Mojigoh (BN – Putatan) denied spending that much: “I am not aware of the allocation.”

He said he would verify the report with Mohd Johari, which he described as “disputable, ridiculous and stupid.” The second-term MP said the maximum he spent last year for festive seasons was less than RM100,000.

“I donated two cows and some kuih-muih for the police and the army respectively on Hari Raya Aidilfitri but the maximum spending was definitely less than RM20,000,” he said.

He said the public could lodge report with the police and the ACA for further investigation over the matter.

Datuk Razali Ismail (BN – Kuala Terengganu), who is the Deputy Education Minister, said it was not true that the money was spent solely on celebrations, saying every MP was given a RM1mil allocation for small projects, activities and donation for the poor.

“I had a lot of functions last year and sometimes we need that kind of money when we need to fix leaky roofs, helping the needy or stuff like that,” he said.

Anwar pledges new economic deal for all

Opposition Leader Anwar Ibrahim yesterday said the Umno/BN-led federal government is in a state of extreme denial even as the world economy is facing an uncertain future.

Indeed, global prospects are so bleak that even proponents of unbridled capitalism like Alan Greenspan and George Soros are getting flustered, claimed Anwar.

Following the sub-prime crisis, the US alone is facing the prospect of a US$3 trillion credit crunch which will emerge soon, according to experts, to dwarf the present financial turmoil.

"I don’t want to be accused of painting too gloomy an economic picture but we are in fact looking at an extended period of slow growth, high inflation and high unemployment.

"A small coterie continuing to rob the nation blind isn’t making our current and worsening economic plight any easier," he added.

It was a long-delayed speech since Anwar had various other engagements after earlier officiating at the PKR Sabah convention. It was an hour before midnight by the time he finished his talk in a packed banquet hall. The talk was held in conjunction with the prize-giving ceremony of the Corporate Goodwill Invitational Golf Tournament.

anwar and economy 290904On a more positive note, Anwar conceded that the economy was not yet too fragile, but he asked for how long this would go on, saying the re-capitalisation of banks following the 1997/98 Asian currency crisis is "important for this moment of economic crisis".

The key to managing the economy in the more challenging future ahead, said Anwar, lies in adopting PKR’s Malaysian Economic Agenda (MEA) which, although formulated before the global financial crisis, provides a basis for the nation to come together on a bi-partisan platform and work towards a better economic future for all.

'Have confidence in your future'

He added that the thrust of the MEA, which retains the salient features of affirmative policies, is relevant to the dictates of the times and urged that "the Malays in particular have confidence in their future".

He dismissed fears that he was an economic alarmist, instead describing himself as an economic conservative. "When you are dealing with the people’s money, that’s the way to go," said Anwar.

"Other nations have bridged the gap between the haves and have-nots more successfully than us without being perceived to be discriminatory to those who have struggled hard.

"Any talk of dismantling the NEP breeds resentment immediately but only among a handful of Umno leaders have long benefitted at the expense of all of us. Yet many Malays have been deluded into thinking the NEP is somehow intended to benefit them, which is not the same as enjoying the benefits, but how many notice the difference?" he asked.

One key feature of the MEA is the institution of an open tender system which will lessen the burden on the consumer, the tax payer and on government finances.

This can be done, according to Anwar, by devising a process which is transparent and accountable and does away with the abuses of the past while factoring in a role for the Bumiputera which will not drive up the cost of doing business or "make us less competitive".

"When government leaders talk about the Bumiputera, what they actually mean is themselves, their wives, son and in-laws," reminded Anwar. "It’s corruption, according to government leaders, when a policeman takes RM50 in bribes but commission when a minister collects RM500 million for himself."

pakatan rakyat penang rally 160608 anwar ibrahimAlthough Anwar didn’t directly touch on the long-delayed Sept 16 plan of his government-in-waiting, he left his listeners with the impression that the opposition Pakatan Rakyat was committed to the idea of a change of government "since the present one has shown itself to be incapable of change".

He touched only briefly on his incarceration and beatings while in detention and in jail but added that "we need to move on" rather than dwell on the past and be bogged down by it, reinforcing the impression that he had forgiven, but perhaps not entirely forgotten.

Oil royalty: SAPP not giving up

Kota Kinabalu: The Sabah Progressive Party (SAPP) is not giving up its struggle for more oil royalty payment for Sabah even though the State Government stated it is not pursuing the matter since the Petroleum Development Agreement is not revisable.

"This is not the end of the story, we will continue to fight for it," said President Datuk Seri Yong Teck Lee commenting on Chief Minister Datuk Seri Musa Aman's explanation during the recent Budget sitting that there is no provision in the agreement to review the five per cent oil royalty.

SAPP Luyang Assemblywoman, Melanie Chia and Sepanggar MP Datuk Eric Majimbun, had both raised the issue at the State Assembly and Parliament, respectively.

"Even the country's Constitution can be amended (so) why can't it be the same for the Petroleum Development Agreement?," said Yong, adding that even if it is stated that the agreement is not revisable, it is not final so long as both the Federal and State governments mutually agree to review.

"We will not be surprised if Kuala Lumpur declines to review because they are taking our resources but it is a surprise that our State Government is also reluctant to call for the review," he said.

Speaking to reporters after the soft opening of the SAPP Putatan Maju Centre near here, Saturday, Yong asked if it was wrong for Sabah and Sarawak to request for a revision on such a lop-sided agreement.

According to him, Parti Keadilan Rakyat de-facto leader, Datuk Seri Anwar Ibrahim also shared similar sentiment on this issue with SAPP.

"This morning (Saturday) we (SAPP leaders) had breakfast with him, to get to know each other and discuss several issues like the economic situation and the review of the petroleum agreement.

"Anwar's stand and (that of the) SAPP is the same on this issue," he said.

Asked if there was any official invitation from Pakatan Rakyat for SAPP to join them, he said there was none.

"But the components in the Pakatan Rakyat understand our position," he said, adding that SAPP is also not answerable to Pakatan Rakyat, especially in the context of its eight-point agenda, one of which is State autonomy.

"The question of whether Pakatan Rakyat agrees with SAPP or not, is not the issue because that is what we call State autonomy.

"We don't have to get permission from anyone outside Sabah to get autonomy," he said, when asked if he had spoken to Anwar about State autonomy.

Nonetheless, SAPP would be constructive and innovative in its relationship with PKR without compromising its autonomy, he said.

"Whether we will be opposing or supporting each other (in the election) our basis is in the eight-point agenda and one of them is State autonomy. So we cannot do anything that compromises our autonomy."

Earlier, Yong said the opening of the SAPP Putatan Centre at the former Sabah Barisan Nasional (BN) headquarters in Putatan Square is a symbolic start for SAPP's struggle.

"I feel proud that SAPP now has gained a foothold in Putatan. As the first step to fight for the rights of Sabah we take over the State BN's office. Our re-branding process that started in October is beginning to show results.

"This is just the beginning (and) there are more great things to come," he said.

He added that so far the party had lost less than 200 members, including one in Tanjung Papat when Datuk Raymond Tan submitted his official resignation letter, but in the past few weeks SAPP had gained more than 1,200 new members.

He also disclosed that SAPP had approved the membership of academician and columnist, Haji Amde Sidek, who is also in the party's think-tank board.

Yong also commended the new members in Putatan led by Dullie Haji Marie, the former Political Secretary to then Minister in the Prime Minister's Department Tan Sri Pandikar Amin Mulia, for joining the party.

"It is very rare that a ruling coalition party component will leave the government of the day and fight for the opposition. It is even rarer that new members join this party knowing very well that the next elections is still a long way to go," he said.

Later, Yong together with SAPP Supreme Council members witnessed the planting of the SAPP flag at the centre by party adviser, Datuk Haji Murshidi Nambi. He also received 612 membership applications from the 10 SAPP branches in Putatan.

MCA LEADERS: Yes, Dr Chua is forgiven but let's get real

I REFER to the letter from Bulbir Singh of Seremban on the purportedly unfair treatment dished out to Datuk Seri Dr Chua Soi Lek by Malaysian Chinese Association president Datuk Seri Ong Tee Keat ("A time to be forgiving" -- NST, Nov 19).

I wish to point out a contradiction in Bulbir's argument.

First, he concedes that "what the MCA president has done is his business and prerogative as party chief". Then he goes on to say the party president should be forgiving, implying that Dr Chua be given a meatier role in the MCA.

An extension of his argument is that since MCA members have by and large forgiven Dr Chua by electing him to the No. 2 post, all should be forgiven and he should be given a clean slate to start anew.

The MCA today is at one of its lowest ebbs since its formation and it is going to be a Herculean task for Ong to assemble a formidable team to lift it out of the doldrums. Having a deputy with a tainted past is certainly not going to help.
One has to remember that the MCA is a component party of the Barisan Nasional. Whatever it says and does will have a bearing at national level.

Is the BN, or in particular the prime minister, prepared to have a minister who is morally tainted to be in his cabinet? In the most unlikely circumstances, if the answer is "yes", he will constantly be the butt of jokes, rendering him ineffective and an embarrassment to his party.

To the writer's question: "Is there no word like forgiveness in our dictionary?"

Of course there is, but the reality on the ground has to take priority over everything else.

US-based Muslim charity convicted of funding terrorism

The leaders of what was once the largest Muslim charity in the United States were found guilty of acting as a front for Palestinian militants in the largest terrorism financing prosecution in American history.
It was a major victory in the White House's legal "war on terror" and comes after a mistrial was declared last year in the case involving the now defunct Texas-based Holy Land Foundation, charged with funneling 12 million dollars to Hamas.
"Today's verdicts are important milestones in America's efforts against financiers of terrorism," Patrick Rowan, assistant attorney general for national security, said in a statement.
"This prosecution demonstrates our resolve to ensure that humanitarian relief efforts are not used as a mechanism to disguise and enable support for terrorist groups."

Family members could be heard sobbing in the Dallas courtroom as guilty verdicts were read on all 108 charges of providing material support to terrorists, money laundering and tax fraud.

One woman cried out: "My dad is not a criminal! He's a human!"

Holy Land was one of several Muslim organizations the Bush administration closed in the wake of the September 11, 2001 terrorist attacks for allegedly raising money for overseas Islamic extremists.

Muslim charities that remain open have reported significant drops in contributions because of fears of prosecution even as juries deadlocked or rendered acquittals or convictions of lesser charges in two other high-profile terror financing cases in Florida and Chicago.

The United States Justice Department vowed in October 2007 to retry the five former charity organizers in the Holy Land case after jurors could not agree on verdicts on nearly 200 charges and a new jury was seated in mid-September.

Over the past two months, the government has presented largely the same evidence hoping to prove that Holy Land was created in the late 1980s to gather donations from deep-pocketed American Muslims to support the then-newly formed Hamas movement resisting the Israeli occupation.

Hamas -- a multi-faceted Islamist political, social and armed movement which now controls the Gaza Strip -- was designated a terrorist organization by the United States in 1995 and the trial centered over whether Holy Land continued to support the group after this point.

Prosecutors did not accuse the charity of directly financing or being involved in terrorist activity. Instead, they said humanitarian aid was used to promote Hamas and allow it to divert existing funds to militant activities.

Defense attorneys said the charity was a non-political organization which operated legally to get much-needed aid to Palestinians living in squalor under the Israeli occupation and argued that the chief reasons their clients were on trial are family ties.

They left the courthouse without comment.

After reading the verdicts, U.S. District Judge Jorge Solis ordered the men detained because of fears they would flee the country before sentencing given their international ties.

Khaled Meshaal, Hamas' political leader in Syria, is the brother of defendant Mufid Abdulqader, a top Holy Land fundraiser whose Palestinian band played at the charity's events and now faces up to 55 years in jail.

Meshaal's deputy, Mousa Abu Marzook, is a cousin of defendant Mohammad el-Mezain, a foundation co-founder, and is married to the cousin of defendant Ghassan Elashi, former Holy Land board chairman.

Mezain faces up to 15 years in prison while Elashi, who is already serving six and a half years for export law violations, faces up to life in prison.

The brother of defendant Shukri Abu Baker, Holy Land's former chief executive officer, is Jamal Issa, former Hamas leader in Sudan and its current head in Yemen. Baker, the former chief executive officer of Holy Land, faces up to life in prison.

A fifth defendant is Abdulrahman Odeh, Holy Land's New Jersey representative, who faces up to 55 years in jail.

Jurors also found that the defendants owed the government 12.4 million dollars.

Obama vows global action on growing economic crisis

US president-elect Barack Obama has pledged to work with global leaders to stem the ever-widening financial crisis, as Washington and Britain moved to shore up their ailing economies.
"The reality is that the economic crisis we face is no longer just an American crisis, it is a global crisis -- and we will need to reach out to countries around the world to craft a global response," Obama said Monday, unveiling his economic team for his administration, which begins January 20.
Obama confirmed the well-traveled Timothy Geithner as his nominee for Treasury secretary, and the internationally respected former Treasury boss Larry Summers as his top economic adviser in the White House.
Underlining the ongoing woes of the financial sector, Citigroup , once the world's biggest banking group, was given a new 20-billion-dollar capital injection lifeline from the US government.

The rescue plan announced late Sunday also saw the government offer guarantees for 306 billion dollars of Citigroup debt, as well as injecting more capital into the struggling bank after a previous 25-billion-dollar infusion.

Citigroup's shares had slumped last week over fears it could follow other banks into the financial void, but surged when trading opened on Monday.

The bailout plan sparked a frenzy on the markets, with Wall Street and European stock markets soaring as investors cheered the news.

The Dow Jones Industrial Average lept 4.93 percent to close at 8,443.39 while the Nasdaq composite soared 6.33 percent to 1,472.02.

In Britain , finance minister Alistair Darling, who forecast a sharp economic contraction in 2009, launched a tax and spending plan worth 20 billion pounds (23 billion euros, 30 billion dollars).

"We need action now to boost economic activity ... to help us emerge quicker and emerge stronger from these difficult times," Darling told lawmakers.

Britain's FTSE index of leading shares rejoiced in the news and jumped 9.84 percent as a stimulus package added to the early momentum on the Citigroup announcement.

An increasing number of countries are devising stimulus packages to boost their businesses and consumers.

Obama may unveil more details of a proposed planned stimulus package at another press conference on Tuesday, with Democrats vowing to draw it up as soon as possible.

The package, should be approved "right now," he said, adding it should be the first order of business for the new Congress in January.

"I think the most important thing to recognize is that we have a consensus, which is rare, between conservative economists and liberal economists, that we need a big stimulus package that will jolt the economy back into shape."

Outgoing US President George W. Bush again pledged that his administration was ready to take all necessary measures to shore up the struggling US economy.

"This is a tough situation for America. We'll recover from it. The first step to recovery is to safeguard our financial system," Bush said after late night talks with Treasury Secretary Henry Paulson.

"And if need be, we're going to make these kind of decisions to safeguard our financial system in the future," Bush told reporters.

A top New York official warned as many as 225,000 jobs could be lost in New York city and state due to the Wall Street crisis.

The US Treasury also announced it was extending a temporary guarantee program for money market funds announced in September until April 30, "to support ongoing stability in this market."

In Asian trading on Tuesday, Hong Kong shares opened 4.3 percent higher, Philippine share prices opened 3.6 percent up, Singapore shares were 3.06 percent higher in early trade, and Japan's Nikkei stock index soared 4.24 percent by the lunch, all reacting to the strong Wall Street rallly.

In Europe, German Chancellor Angela Merkel warned the European Union Monday not to rush out its multibillion-euro package to steer the 27-nation bloc through the global slowdown.

Following talks with French President Nicolas Sarkozy, Merkel also said France and Germany would not follow Britain's lead by slashing value-added tax (VAT) to stimulate spending as a way to fight the economic downturn.

The European Commission was set to unveil proposals for a Europe-wide government spending and tax relief plan on Wednesday.

The CAC 40 index in Paris surged 10.09 percent, its second biggest ever single day gain, and in Frankfurt the DAX advanced 10.34 percent.

ROADS in rural areas are substandard because the contractors had sub-contracted the work, a backbencher said yesterday.

"Projects are sub-contracted and quality is compromised," said Datuk Tajuddin Abdul Rahman (BN-Pasir Salak)

"For example, for a road project worth RM500,000, half goes into the pockets of those who got the job. The eventual sub-contractor will be left with RM250,000 to build the road. What materials can you get other than lower quality stuff?" he asked during the debate on the Work Ministry's allocations at the committee stage.

He said he was not against contractors making a profit.

"But if the margin goes up to 60 per cent of the value of the project, then something must be wrong."
Tajuddin said some of the main contractors were just licence holders who did nothing except take a cut and leave the work to others.

"They farm out the work to others. So, in the end, the road is built with sub-standard materials."

Datuk Dr Marcus Mojigoh (BN-Putatan) said the Public Works Department should also look at the way the projects were being monitored.

"Surely this could not have happened if there was proper monitoring."

Tajuddin agreed, saying that monitoring of projects must have been compromised by those on the ground.

There were more complaints about roads from Alexander Nanta Linggi (BN-Kapit), who regretted the delay in the construction of the Kapit-Sibu link.

"It was to have been built under the Seventh Malaysia Plan but was pushed to the Eighth Malaysia Plan. Now, I am told it will be built under the Ninth Malaysia Plan.

"What am I going to tell my constituents?"

Datuk Seri Tiong King Sing (BN-Bintulu) quipped that only God knew the day when some of the road projects in Sarawak would be completed, as promises had been made for so long that the public had grown weary of them.

He said many roads were to have been built but the PWD had either postponed or delayed the work.

"I hope the ministry will be able to give a comprehensive answer to the status of various road projects in the state."

Dr Che Rosli Che Mat (Pas-Hulu Langat) called on the government to widen the Batu 9-Dusun Tua trunk road in his constituency.

"The road is in a bad shape. I hope the government will repair and widen it."

ROADS in rural areas are substandard because the contractors had sub-contracted the work, a backbencher said yesterday.

"Projects are sub-contracted and quality is compromised," said Datuk Tajuddin Abdul Rahman (BN-Pasir Salak)

"For example, for a road project worth RM500,000, half goes into the pockets of those who got the job. The eventual sub-contractor will be left with RM250,000 to build the road. What materials can you get other than lower quality stuff?" he asked during the debate on the Work Ministry's allocations at the committee stage.

He said he was not against contractors making a profit.

"But if the margin goes up to 60 per cent of the value of the project, then something must be wrong."
Tajuddin said some of the main contractors were just licence holders who did nothing except take a cut and leave the work to others.

"They farm out the work to others. So, in the end, the road is built with sub-standard materials."

Datuk Dr Marcus Mojigoh (BN-Putatan) said the Public Works Department should also look at the way the projects were being monitored.

"Surely this could not have happened if there was proper monitoring."

Tajuddin agreed, saying that monitoring of projects must have been compromised by those on the ground.

There were more complaints about roads from Alexander Nanta Linggi (BN-Kapit), who regretted the delay in the construction of the Kapit-Sibu link.

"It was to have been built under the Seventh Malaysia Plan but was pushed to the Eighth Malaysia Plan. Now, I am told it will be built under the Ninth Malaysia Plan.

"What am I going to tell my constituents?"

Datuk Seri Tiong King Sing (BN-Bintulu) quipped that only God knew the day when some of the road projects in Sarawak would be completed, as promises had been made for so long that the public had grown weary of them.

He said many roads were to have been built but the PWD had either postponed or delayed the work.

"I hope the ministry will be able to give a comprehensive answer to the status of various road projects in the state."

Dr Che Rosli Che Mat (Pas-Hulu Langat) called on the government to widen the Batu 9-Dusun Tua trunk road in his constituency.

"The road is in a bad shape. I hope the government will repair and widen it."

Sessions court to decide on hearing of Raja Petra’s case on Friday

The Sessions Court here will decide on Friday whether or not it has the discretion to hear blogger Raja Petra Kamaruddin’s defamation case.

Judge Mohamad Sekeri Mamat deferred decision after hearing submissions from both parties today.

The trial was fixed for this week but Raja Petra’s counsel, Manjeet Singh Dhillon, made a preliminary objection yesterday asking the court to send the case back to the Magistrate’s Court for trial on the grounds that the magistrate’s order was illegal, void and contrary to the law.

On Aug 15, magistrate Nazran Mohd Sham allowed the prosecution’s application to transfer the case to the Sessions Court on the ground that it involved public interest.

Raja Petra, the Malaysia Today editor, is alleged to have defamed the deputy prime minister’s wife, Datin Rosmah Mansor, acting colonel Abdul Aziz Buyong and his wife, Colonel Norhayati Hassan, in his statutory declaration made at the Civil High Court in Jalan Duta here at 10.25am on June 18.
If convicted, he faces up to two years in jail or a fine, or both, on each charge under Section 500 of the Penal Code.

Manjeet Singh informed the court today that he had filed a notice of motion, supported with Raja Petra’s affidavit, to the High Court seeking an order to transfer the case back to the Magistrate’s Court or to refer it to the Federal Court on the constitutional issue.

However, deputy public prosecutor Anselm Charles Fernandis said the defence application had no effect as the High Court on Sept 11 stated in a letter that the magistrate’s order to transfer the case to the Sessions Court was right according to law principles.

The decision in the letter from Justice Suraya Othman was in response to the defence application for a revision of the magistrate’s order, he said.

He cited two cases decided by the Federal Court that under Article 145 of the Federal Constitution, the Attorney-General had vested power to choose any court to initiate proceedings against a person.

This, coupled with the High Court decision, showed that the Sessions Court had the discretion to hear Raja Petra’s case, Fernandis added. — BERNAMA

More patrol boats needed to fight global threats, says PM

LUMUT: The government will build the second batch of new generation patrol boats for the navy once the first batch of six boats has been delivered by 2010, said Prime Minister Datuk Seri Abdullah Ahmad Ba-dawi.

Abdullah, who is defence minister, said the navy and other maritime agencies were facing more challenges following increased threats to ships across the world.

He said the hijacking of Malaysia International Shipping Corporation vessels by pirates off Somalia showed how important it was for the navy to strengthen itself to face these threats. Abdullah said this at the naming of patrol boat KD Kelantan at the navy base here yesterday.

His speech was read by Deputy Defence Minister Datuk Wira Abu Seman Yusop.

The boat was named by Raja Pe-rempuan Tengku Anis Tengku Abdul Hamid of Kelantan.
Present were Sultan Tuanku Ismail Petra Sultan Yahya Petra of Kelantan, Tengku Mahkota Kelantan Tengku Muhammad Faris Petra Sultan Ismail Petra, Raja Di Hilir Perak Raja Jaafar Raja Muda Musa and Raja Puan Muda of Perak Raja Nor Mahani Raja Shahar Shah.

Abdullah said the government noted the initiative of Boustead Naval Shipyard in introducing the vendor development programme, which saw a high level of participation by local companies.

He said the government hoped these companies would grow and be active in the support, repair and manufacturing services.

"The government also hopes local firms will handle all these services in the future so the country can save cost, maximise profit for local entrepreneurs and curb the outflow of capital."

He said the government hoped these firms would expand abroad through partnerships with foreign companies.

"As such, the government will continue to provide support, and occasional funds, to the industrial sector, especially in the fields of specialisation and high-technology, such as this patrol boat-building programme."

Boustead Naval Shipyard managing director vice-admiral (Rtd) Datuk Seri Ahmad Ramli Mohd Nor said more than 1,000 local companies were participating in the patrol boat-building programme, and more than 60 per cent of them were Bumiputera firms. -- Bernama

Latest Dewan Rakyat: Two-day suspension for Gobind

A decision not to refer a Minister to the Rights and Privileges committee culminated in an opposition member being suspended from the House for two days.

Gobind Singh Deo (DAP-Puchong) was thrown out from the House after he told deputy speaker, Datuk Wan Junaidi Tuanku Jaafar that he was being biased.

"He (Nazri) makes the mistake and you are punishing me," he told Wan Junaidi after the deputy speaker and Gobind got into an arguement over the merits of his decision not to refer Nazri to the rights and privileges committee.

The drama which resulted in Gobind being thrown out began after Question Time ended when Wan Junaidi started ruling on Karpal's claim that Nazri had misled the House two week ago when replying to points raised on the Judicial sackings of 1988.

Nazri had told the House at that time that three judges were never sacked but were told to take early retirement. Subsequently, he clarified, that the three judges were sacked but were given a pension after the then Yang diPertuan Agung appealed to the chief secretary of the government for them to be paid a pension.
Yesterday, in ruling on the case, Wan Junaidi told the House that Nazri had not deliberately "mislead" the House as claimed by Karpal.

"At that time, he base his statment on the facts of the case. He did not deliberately make the statement. He subsequently clarified. I therefore rule that he does not have to be referred to the rights and privileges committee," he said.

This then saw an exchange of words between Karpal Singh (DAP-Bukit Gelugor) and Wan Junaidi which saw several opposition members taking part.

The exchange lasted a good 30 minutes and it reached a culmination when Gobind demanded to know how Wan Junaidi had reached his decision without asking Nazri Aziz to explain himself.

He declared that Wan Junaidi was making a mockery of parliament.

At his point, Wan Junaidi lost his temper and called for Gobind to be removed for two days.

Najib: We will take steps to end money politics

LIMA: Datuk Seri Najib Razak said money politics in Umno cannot be eradicated overnight but the party will come up with measures to stop the menace.

Speaking after attending the Asia Pacific Economic Cooperation leaders meeting here on Sunday, the deputy prime minister and Umno deputy president said vote-buying in the party had to be fought with commitment and political will.

He was responding to criticism, including by former prime miniser Tun Dr Mahathir Mohamad, who said even Najib would find it difficult to stop money politics in Umno when the latter became prime minister.

Najib said: "During Tun's time, he did introduce steps to eradicate money politics in Umno. It is not easy but there must be the will and commitment to do so.

"The fight against money politics must be comprehensive and it is a process that will involve time."
In Kuala Lumpur, Umno disciplinary board chairman Tengku Ahmad Rithaudeen Tengku Ismail said proposals for additional initiatives to curb corruption in the run-up to the March elections were being studied.

He said these included cooperation with the Anti-Corruption Agency (ACA).

"We have to find new ways to reduce money politics in the party. We cannot allow this disease to spread as it would have negative implications on the party."

However, he declined to elaborate on the measures.

The disciplinary board was established when Dr Mahathir was party president. In 2000, Umno held an extraordinary meeting to discuss amendments to its constitution.

These included the formation of the disciplinary board. Tengku Rithaudeen was appointed its first chairman in 2001.

The board, however, has had little effect on the reportedly widespread buying of votes at Umno elections.

Tengku Rithaudeen said Umno members had to be continually educated on the ills of money politics.

"Some members take it lightly and do not see the need to lodge reports. These are the things which we must correct."

On cooperation with the ACA, Tengku Rithaudeen said a few meetings had been held.

"Things are progressing smoothly. We are looking into how the disciplinary board and ACA can work together to overcome money politics."

Earlier this month, he met ACA investigations director Datuk Shukri Abdull about battling corruption in the party.

Meanwhile, sources said some divisional leaders who were elected during the divisional meeting recently were expected to be called up by the board.

They are said to have corruptly secured their positions during the divisional meetings which began on Oct 9.

As of Friday, the board has received 837 complaints, including reports of money politics.

So far, 181 cases have been investigated, 31 of which were called to show cause and 18 people found guilty.

Pengarang harakah...
Kalau nak berjuang Islam Alhamdulillah aku sokong, tapi sejak akhir2 ini aku
lihat hang dengan BN sama-sama beralasan. Isu Babi dapat diserang oleh BN
yang sekular kerana hang pa dari PAS terutamanya pemimpin PAS dan bingung
dan suka mengalah dengan kuasa kuffar.

Jadi bila hang berpaling dari petunjuk jangan marah pulak, sehingga orang
yang sekular macam BN boleh pekena kat kita. Contoh kes Babi (ini isu
sensitif) yang boleh diputarbelit oleh BN tapi pemimpin pAS sekarang yg dok
berpusing2.

Babi diluluskan zaman BN lagi dan sekarang sepatutnya PAS ada kuasa untuk
hentikan tunjukkan sikit maruah Islam. Ini dok mengalah, lepas tu berlagak
tulis dalam harakah macam bagus sangat.

Wahai pemimpin PAS kembalilah semula kepada perjuangan asal. Jangan
bersekongkol dengan puak2 kafir Harbi DAP dan jangan pula tinggal
segerombolan denga puak SEKULAR Keadilan, kembalikan maruah Islam.

Sepatutnya usaha tersebut perlu disokong kerana ia boleh mengembalikan
remaja kepada keinsafan dan dapat mengelakkan mereka terjebak dengan gejala
sosial.

Pengurus Tabung Amanah Tok Kenali, Mohd Khir Zahri Abdul Ghani berkata,
berkata klip video Sajak Kematian tiada sebab cuba dihalang ditayang kepada
umum, kalau perkara itu boleh menimbulkan keinsafan.

"Mengapa sekarang ada orang kalut dengan Sajak Kematian yang ditayangkan
kepada pelajar sedangkan perkara itu boleh mendidik mereka dan dapat
mengelakkan daripada terjebak dengan gejala sosial.

"Penayangan klip video tersebut boleh memberi kesedaran kepada golongan
remaja kerana ia menceritakan bagaimana keadaan orang yang melanggar suruhan
agama ketika berada dalam kubur," katanya di sini.

Baru-baru ini, Menteri Pelajaran, Dato' Seri Hishammuddin Hussein dilaporkan
mahu video klip Sajak Kematian yang ditayang di sekolah disiasat kerana ia
dianggap tidak sesuai bagi pelajar sekolah rendah.

Mohd Khir berkata, kalau nak gambarkan sepenuhnya alam kematian tidak boleh
kerana perkara berkaitan alam ghaib hanya sekadar imaginasi sahaja.

Menurutnya, mungkin bagi mereka yang menentang penayangan klip video
tersebut merasakan tercabar dengan perbuatan mereka sekarang.

"Namun penayangan kepada anak di bawah umur yang belum akil baligh memang
tak sesuai sebab mereka ini tidak boleh memikirkan tentang baik dan buruk
secara mendalam," katanya.

Bekas Pengetua Sekolah Menengah Kebangsaan Agama Wataniah Machang, Ustaz
Mohammad Awang berkata, penayangan klip video tersebut wajar bagi memberi
peringatan terhadap wujudnya alam barzakh.

"Rasulullah saw sendiri pernah ditanya apakah amalan yang paling baik
diamalkan, lalu baginda menjawab ialah mengingati kematian merupakan yang
terbaik," ujar beliau.

Kata beliau perkembangan alat-alat teknologi wajar dimanfaatkan bagi
pembikinan klip video seperti itu sebagai usaha mendidik golongan remaja
yang sudah akil baligh.

"Saya berharap klip video itu tidak diharamkan penayangannya tetapi pihak
yang terlibat kena memberitahu klip video tersebut hanyalah imaginasi dan
bukannya gambaran sebenar alam barzakh." katanya.

Naib Ketua Dewan Pemuda PAS Kelantan, Ustaz Abdul Latiff Abdul Rahman
berkata, pembikinan klip video tersebut wajar ditayangkan kepada umum
terutamanya ahli-ahli politik, ketua-ketua jabatan, pemimpin masyarakat dan
banduan di penjara.

Menurut beliau setidak-tidaknya dengan ada peringatan seperti itu akan
mengelakkan mereka terjebak dengan perkara mungkar.

"Bagi saya ia wajar ditayangkan namun bukan untuk golongan kanak-kanak di
bawah umur," ujarnya.

Katanya beliau Sayid Qutb dalam kitabnya 'Tayangan Kiamat' telah
mengumpulkan ayat-ayat yang berkaitan dengan alam kubur, Padang Mashyar,
nikmat-nikmat di syurga dan azab neraka dalam kitab yang ditulisnya itu.

Bekas Yang Dipertua Abim Kelantan, Ustaz Muhammad Mustaffa berkata, alam
ghaib tidak boleh digambarkan melalui pemikiran manusia.

"Tinggal lagi sejauh manakah penerimaan masyarakat umum terhadap penayangan

BUPATI ITU ORANG "CINA"....!! !

Belum terlalu hilang dari ingatan: hingar bingar, nyala api,
asap hitam membumbung, teriakan massa anarkis memporak
porandakan isi Jakarta, Medan dan Solo di peristiwa Mei 98.
Tiba-tiba di tahun 2005 seorang etnis Tionghoa bernama Ahok
terpilih menjadi bupati di daerah basis Masyumi-Belitung
Timur.

Ir. Basuki Tjahaja Purnama MM bernama asli Zhong Wan Xie
lahir di Manggar pada tanggal 29 Juni 1966. Masyarakat
Bangka-Belitung dan juga sebagian Jakarta memanggilnya
Ko Ahok (elder brother Ahok). Sosoknya tinggi di atas rata-rata
manusia Asia. "ini fenomena besar" kata Ahan, seorang pemuda
Tionghoa, ketika membaca berita pelantikan "Bupati Ahok"
di medio 2005 setelah mengantongi 37,13% suara pemilih.

Ada nada haru, tidak percaya sekaligus kaget, tampak
pada raut wajah dan sorot mata pemuda Ahan kala itu.
Bagaimana mungkin, seorang Tionghoa bisa dipilih di sebuah
daerah berkomposisi 93% muslim pribumi. Tetapi di tahun itu,
Ahok terpilih lewat mekanisme demokratis dan termasuk
paling bersih dalam sejarah pilkada di Indonesia.

Salah seorang peserta diskusi regular Sinar Harapan pernah
berkata bahwa Ahok adalah bupati pertama beretnis Tionghoa
setelah zaman Mataram. "Baguslah, Indonesia ada perubahan"
kata Wignyo Prasteyo, aktifis 98 yang terlibat dalam perjuangan
reformasi. "Pluralisme dan kesetaraan before the law mesti
terus diperjuangkan" kata Wignyo.

Nada pesimis tetap dapat ditemui di sela-sela optimisme
beberapa kalangan. Limwiss, seorang karyawati perusahaan
Jepang di Jakarta, berkata "Soalnya siapa pun orang Chinese
jadi pemimpin di Indonesia tidak ada pengaruh. Posisi orang
Chinese itu berat di pemerintahan. Sana-sini kena". Sedangkan
laporan TEMPO menyatakan Ahok adalah pahlawan baru
bagi sebagian besar warganya.

"Kamu ini benar-benar anak ideologis bapakmu" kata mantan
wakil walikota Pangkalpinang kepada Ahok di sebuah pesta resepsi
pernikahan temannya. Beberapa kelompok menolak Ahok berdasarkan
surat Al-Maeda 51 yang menolak non-muslim untuk menjadi
pemimpin. Endah Handayani Syarif, putri pejabat PT. Timah di
Belitung Barat mengatakan "keluarga kami memilih Ahok dengan
alasan mencoba yang baru. Ahok kan "cina", selama
ini pribumi yang mimpin tapi kita tetap aja susah".

Di akhir masa kekuasaan Suharto, terdapat seorang menteri
beretnik Tionghoa bernama Bob Hasan (The Kian Seng) dalam
formasi menteri Kabinet Pembangunan VII Orde Baru . Hasan,
teman bermain golf Suharto, menduduki kursi menteri
hanya sekitar 2 bulan. Banyak pihak menuding bahwa naiknya
anak angkat Jenderal Gatot Subroto itu tidak lebih sebagai
permainan Suharto untuk menampilkan "wajah-reformis" . Setelah
reformasi bergulir, jerat hukum mengharuskan Bob Hasan, yang
juga sering dijuluki "raja kayu", mendekam di penjara Nusakambangan
karena terbukti melakukan tindak kejahatan korupsi.

Sebelum Ahok menjadi bupati, pentas politik nasional juga
dimeriahkan oleh kiprah Kwik Kian Gie. Antara tahun 1999-2000,
KKG menjabat Menteri Kordinator Ekonomi di pemerintahan Gus
Dur. Berbeda karakter dengan Muhamad "Bob" Hasan, seorang
Kwik Kian Gie tetap diakui sebagai tokoh bebas KKN disamping
analisa-analisa ekonominya selalu menjadi bahan pembicaraan
kalangan akademisi dan pelaku ekonomi.

Tetapi jabatan eksekutif di pemerintah daerah tingkat dua seperti
bupati dan walikota memiliki kekhususan tersendiri, dibandingkan
dengan anggota legislatif (DPR-RI) maupun jabatan pembantu
presiden sebagai menteri negara. "Karena seorang bupati bersentuhan
langsung dengan rakyat, melihat secara langsung penderitaan
dan masalah rakyat di akar rumput", kata Tutut Herlina, aktifis
yang sekarang menjadi wartawan.

Istilah Bupati berasal dari bahasa Sansekerta "Bhupati" yang
berarti "raja dunia". Sebelum tahun 1945, gelar bupati hanya
dipakai di pulau Jawa, Bali dan Madura. Pasca reformasi dan
pelaksanaan otonomi daerah, seorang bupati memiliki kewenangan
menjalankan pemerintahan daerah yang ditetapkan oleh DPRD
tingkat 2. Kekuasaan seorang bupati diperoleh atas mandat
dipilih langsung oleh rakyat setempat melalui mekanisme
pilkada. Sekalipun pasangan calon bupati dan wakil bupati
masih ditetapkan oleh partai politik. Baru-baru ini UU calon
independent memungkin calon bupati tidak diusung oleh
partai politik.

Selama menjadi bupati, Ahok selalu membuka lebar
kaca jendela mobil dinas Nissan Terano-nya. Ia tak segan
menyapa setiap orang yang kebetulan berpapasan, entah
itu pribumi, Tionghoa, Kristen, Islam, Konghucu, Budhis
diperlakukan setara dan penuh hormat.

Sekalipun diusung oleh 2 partai gurem: PIB dan PNBK, Ahok
menggebrak 2 masalah utama masyarakat yaitu Pendidikan
dan Kesehatan.

Jaminan pendidikan bagi rakyat menjadi tren kampanye
calon bupati/walikota di seluruh Indonesia pasca Ahok. Tetapi
menurut Ahok, dia tidak pernah menggratiskan pendidikan
dan kesehatan. Pola "gratis-gratisan" tidak sehat menurut
Ahok. Ia hanya menjamin bahwa siapapun rakyat, terutama
rakyat tidak mampu, harus dapat mengakses pendidikan dan
kesehatan. Di bawah kepimpinan Ahok pula, belasan siswa
berprestasi dapat dikirim kuliah ke Jakarta lewat program
bea-siswa. Setiap siswa disubsidi Rp 1 juta perbulan.

Aneh, Ahok melakukan gebrakan ini tanpa didukung oleh
dukungan partai politik di DPRD. Rasionalitas politik menyatakan
bahwa hanya seorang bupati dengan basis dukungan kuat partai-politik
saja yang mampu melakukan gebrakan seperti ini. Itu pun
sangat jarang kita temui di seantero Indonesia. Biasanya,
walikota/bupati lebih sibuk berkongkalikong dengan anggota
dewan dan pengusaha daripada "ribet urus" rakyat.

Program jaminan pendidikan dan kesehatan dilaksanakan
Ahok dengan menerapkan jurus dagang. Ia berdebat keras
hingga mampu menaklukan PT. Askes dalam urusan premi
kesehatan rakyat Beltim. Hasil tawar-menawar antara Bupati
Ahok vs PT. Askes menghasilkan sebuah kesepakatan bahwa
pemerintah daerah cukup membayar separoh harga normal untuk
menopang biaya asuransi kesehatan 50 ribu penduduk Beltim.
"itu baru bener" kata Asri, staf Komnas HAM. "Bupati
memang harus tidak korupsi dan menggunakan anggaran
negara untuk masyarakat. Jangan dikorup kayak bupati-bupati
lain", tambah Asri yang berjilbab hitam.

Sebelum Ahok, tidak ada bupati yang memotong biaya
perjalanan dinas dari Rp. 1 milyar per tahun menjadi
seperlimanya. "Gila, hebat amat" kata Web Warouw, wartawan
Sinar Harapan. "Seandainya setengah dari 400 kepala daerah
tingkat 2 seperti Ahok, beres negara ini", lanjut Web dengan
penuh harapan.

Laporan TEMPO menurunkan berita bahwa menurut para
pegawai negeri Belitung Timur, Ahok sangat keras menerapkan
disiplin. Mereka yang ketahuan "kongkow" pada jam kerja
langsung mendapat sangsi, ditahan kenaikan pangkatnya.
Di sisi lain, Ahok memberi honor untuk para ketua RT Rp.
300 ribu, Ketua Dusun Rp. 640 ribu, dan Kepala Desa
Rp. 2 juta per bulan. "ternyata cukup ya anggaran negara
kalau tidak dikorupsi oleh bupatinya", celoteh Asri dari
Komnas HAM.

Keberpihakan dan prestasi Ahok selama menjabat bupati
dihargai oleh Gerakan Tiga Pilar Kemitraan yang terdiri dari
Masyarakat Transparansi Indonesia, KADIN dan Kementerian
Negara Pemberdayaan Aparatur Negara sebagai pejabat negara
anti korupsi.

Oleh majalah TEMPO, Ahok terpilih sebagai 1 di antara
10 tokoh yang mampu mengubah Indonesia. "Ahok semestinya
menjadi 'Obama-Indonesia' , bukan si Rizal Malalareng" kata Ahan
di sela-sela aktifitas menjual bubur ayam di depan rumahnya
yang berdekatan dengan pasar tradisional di kawasan Jelambar
Jakarta Barat
