Kg Buah Pala: Can you sell something that you don’t own?

How could the Penang state government under the BN sell the Kampong Buah Pala land when “the available evidence seemed to show that the land is still vested in the Federal Lands Commissioner”, wonders a bewildered P Ramakrishnan.

Negative elements - greed, corruption, abuse of power and judicial indifference - have conspired to wipe out part of Penang’s history and destroy its heritage.

History and heritage are assets of a nation and they should be preserved for posterity. All civilised nations take pride in their history and heritage and accord them the rightful place in honouring these assets.

But we in Malaysia do not attach as much affection and concern for our history and heritage. There was a time when we even considered getting rid of the Merdeka Stadium to make way for commercial projects.

Merdeka Stadium is best remembered as the place where our beloved first Prime Minister, Tunku Abdul Rahman, declared this nation’s independence. It represents so many memories and so much history but that meant nothing to human avarice. Thank God it did not take off but the point is we were even prepared to commit this sacrilege!

Then there was an attempt to shift the well-known St Michael’s Institution in Ipoh somewhere else just because it was in the middle of a fast growing township. But St Michael’s was there long before so-called development caught up with it. Thank God it did not take place!

But Bukit Bintang Girls’ School in Kuala Lumpur was not that fortunate. This famous school, which was a landmark in the history of our education, had produced so many brilliant students and leaders but that notable achievement did not spare it. It eventually lost to development and greed. It was demolished to make way for commercial purposes. Though the school was shifted elsewhere, they made sure that its history would not continue. They got rid of that famous name: BBGS. They did not even bother to retain the old name of the school to honour its history and contribution to our education.

I’m sure there are numerous other examples of indifference and sacrilege.

But the latest example to wipe out history and a legacy that goes back nearly 200 years and make way for greed and corruption is taking place in the Pearl of Orient: Penang’s version of High Chaparral is facing extinction within a matter of weeks.


How did the Penang govt acquire the land?

Much has been written about the history of this community that has been occupying this parcel of land which has been home to more than five generations of descendants. Therefore it is unnecessary to dwell on this.

What I’m interested in is how this land was acquired by the Penang Government Officers Cooperative – Koperasi Pegawai Kerajaan Pulau Pinang. How was the cooperative able to obtain this parcel of land below market value? Did the officers who were influential and closely linked to the Barisan Nasional Government and Umno just help themselves to it with the blessings of the Penang state government? After all it was Umno that was effectively running the government and who would have dared to question it or oppose whatever that was done by the Umno Exco Members?

Did the land actually belong to the Penang state for these officers to grab it on behalf of their cooperative?

According to legal circles, this land was under a trusteeship. But this trusteeship was dissolved by an Act of Parliament in 1976. When this took place, we are told, this parcel of land reverted to the federal government. The ownership of this land, it is believed, is still with the federal government.

It is a mystery why the BN government deprived these poor Kampung Buah Pala residents of their land by passing this Act of Parliament. The BN with its majority simply took over this land – nay, it just robbed them of their land.

There is no evidence that the Penang state government had ever paid a premium to buy back this land. There is no evidence when this land reverted back to the state of Penang. In all probability, the land is still vested in the Federal Lands Commissioner.


A repeat of the Nizar case

That being the case, how was this land transferred to the cooperative? There appears to be a fraudulent transfer of land which is a very serious matter. Why did the Court of Appeal and the Federal Court totally ignore this vital point when the residents turned to these courts for justice?

It is significant to note that the High Court Judge had ruled that the villagers and the residents of Kampong Buah Pala have a claim to this land.

In a well-argued judgment, Justice O’ Hara had clearly established that there are points to be tried before the courts and there are issues for the courts to weigh and consider before arriving at the truth as to the ownership of the land.

In upholding the decision of the Deputy Registrar (DR), Justice O’ Hara referred to the DR’s ruling, “There is no evidence before this court that the land in question had reverted back to the state under the operation of the old Article 84. The ownership of the land when it was purportedly alienated to the 2nd defendant - Koperasi Pegawai Kerajaan Negeri Pulau Pinang - is an important issue to be considered and for that reason I am not prepared to grant summary judgment as sought by the 2nd and 3rd defendants.”

The Court of Appeal totally ignored the valid points raised by the High Court and, without any legally established basis, ruled in favour of the defendants in setting aside the High Court ruling.

This decision seemed to be a repeat of Nizar’s case in which the High Court in a sound judgment had ruled that Nizar was the legitimate Menteri Besar of Perak at all material times. But the one-man Appeal Court set aside this finding without any written judgment. This scandalous situation was re-enacted in the case of the Kampung Buah Pala case.

In both cases the Federal Court was a total disappointment. In the Buah Pala case, it ruled that the plaintiff had no locus standi. How could this be so when the residents of Buah Pala can trace their ancestry to more than five generations!

It is this vital and critical point that has to be addressed. Whose land is it? Does it belong to Penang? If so, what is the evidence and where is it?

If “the available evidence seemed to show that the land is still vested in the Federal Lands Commissioner, regardless of whether the Commissioner is aware of that fact” as contended by the Deputy Registrar, how could this transaction have taken place?

Can you sell something that you don’t own? Or transfer something that you don’t have? That is the only question that deserves an honest answer.

Sweeping police percentages!

Tan Sri Musa Hassan.

FOLLOWING reactions to the terrible tragedy of political aide Teoh on 16 July 2009, I was drawn to the figure put forth by police chief Musa: 60%.

Odd, I thought. That figure is surprisingly accurate. Nowhere has Musa been reported to have noted that the number was an estimate. Our investigations are 60% done, he said. No more, no less. Not 60.35%. A round 60.

So I call Malaysian Statisticians for Verisimilitude Union (MSVU) president Datuk Ong Chin Teng. I ask him whether it would be accurate, or even possible, for the IGP to affix a percentage to a police investigation. I am assuming that such an investigation, by definition, could not be quantified in the same way one may quantify — say — the download progress of a pirated .avi copy of Harry Potter and the Half-Blood Prince.

To my surprise, Ong answers that, yes, it is possible to do so.

"There are many different tasks that the police would undertake in the course of this inquest: analysing glass fragments, measuring the height of the building, checking the timeline of events," Ong says.

"If we contrast the tasks already performed with the total tasks on schedule, we can arrive at a number."

But surely there are some elements to detective work, such as new evidence, or witnesses who come forward, that would mean such a convenient number would be thrown off?

"It is standard practice for statisticians to allocate about 10% of the final estimation to 'surprise factors'," Ong explains. He adds that this number remains constant, as studies of criminal investigation trends have shown that the probability of "surprise factors" usually arises in predictable quantities.

"The probability of the 15% error margin being accurate is 94.2%," Ong says.

"It's very human to think that there are things we can't put numbers to," Ong continues. "But the truth is, you can apply a figure to everything. Just look at economics!"

The Fendy-Kevorkian theory revisited

Ong reveals that according to the Fendy-Kevorkian theory — and philosophy — of "social tally accumulation", almost everything can be counted and calculated for: from life expectancy, to the grief felt by any one individual at a funeral, to abstract concepts such as equality and moral good.

This paradigm of looking at the world was new to me. The last percentage number that directly affected my life was 64% — the result of my SPM-level Math exam.

Intrigued by Ong's sharing, I decide to do more reading about Jack Fendy and Richessa Kevorkian. With their "social tally accumulation" principle, these two brilliant actuarial scientists from Gallaher College, Vermont, had discovered an equation that was capable of accounting for... well, practically anything!

P(k) = AccnT (12 + z)-1

Where "P" is total precipitate;

"k" is the ratio of deferrable expenses to the estimated gross results;

"AccnT" is the number of certified accountants involved in the tally, times the duration of the tally, averaged daily;

and "z" is the amount of unknown unknowns involved.

While "social tally accumulation" was devised in 1965, its methodologies wandered in the wilderness for decades, and developed its reputation as a fringe science. Statisticians now put this down to the fact that the technologies of the time were just not able to cope with the amount of number-crunching required to employ the Fendy-Kevorkian equation effectively. This rendered it impractical for everyday application.

Today, however, with fairly capable arithmetic machines in our pockets, the Fendy-Kevorkian equation is available for any person to use. Surfing online, I find numerous iPhone applications that require users to merely fill in a questionnaire of quotidian details. Here is one to calculate satisfaction in one's romantic life.

"Social tally accumulation" has revolutionised many aspects of society, including politics. Political scientist Roy Arundhati, in his landmark essay The Calculus of Unbridled Equality (not to be mistaken for Indian writer Arundhati Roy's The Algebra of Infinite Justice), concludes:

"Through application of the life-quantifying solutions provided by F-K theory, politicians in burgeoning democracies have been able to accurately read the moods of their electorate. Political parties across the globe are now using focus groups and statistical science to tailor their platforms to respond to voters, and alter their perceptions."

Arundhati argues that this means politicians are better able to "push through popular partisan agendas", thereby satisfying their respective "citizen-adherents".

Far-reaching effects

Ong agrees that the Fendy-Kevorkian theory had far-reaching effects. He points out that statisticians like himself were being employed by Malaysian parties — on both sides of political spectrum — to determine campaign and administration strategy.

"I just drew up a paper on the Teoh issue for a Member of Parliament (MP): in real, hard numbers, what the death means for the state of Selangor, and how these circumstances may benefit or hinder laying out their strategies in the next few months," Ong says. He declines to reveal the identity of the MP in question, due to a confidentiality agreement.

"The data suggests that Teoh's death was actually good for both the ruling and opposition coalitions," Ong quips — about 60%, with a 5% error margin, for either.

My mind 75.4% blown, I decide to ask Ong about the amount of hope Malaysians currently have for positive political change.

"That's about 37.6%," Ong says. "But I think there's a 94% chance that figure will change in the next six months!"

I also ask Ong to calculate my probability of a romantic encounter in the next month. He gives me an answer — but some data, naturally, belongs in the private sphere.

开放表层覆盖土著保护政策 纳吉未解决经济结构性问题

【本刊特约梁文志】眨眼间,首相纳吉已上任100天。凭心而论,在这短短的100天以来,纳吉的确交出了一些成绩单。当然,这当中有褒有贬。在这里,我稍微简单总结一下纳吉的施政方向:纳吉巧妙地避开了最弱的政治那一环,专攻经济与外交两大方向,在国内外建立起自己的地位与威望。
纳吉选择经济与外交,而非政治,作为立足之点,显然有其考量因素。经济上,全球经济危机的爆发,为纳吉创造了一个天时地利人和的契机,将本身打造成一个把经济从崩溃边缘救回的救世主。
外 交上,曾经在其父亲敦拉萨与马哈迪领导下攀上巅峰的马来西亚,却在阿都拉时代逐步退色。纳吉借尸还魂,在已扎稳的外交地位上,大打外交牌,树立本身在国际 和区域间的鲜明形象。由于炸尸案和霹雳州夺权等道德问题令他形象大损、坠入窘境,因此比较起政治,经济与外交两大筹码更能有效地建立纳吉的威望。
从经济层面来看,纳吉在上位的100天内,就为马来西亚带来了过去近40年来从来不曾出现过的重大改变:打开潘多拉宝盒,废除了捆绑多年的土著扶持政策,并将全面自由化与开放市场的政策释放出来。
不 管是基于全球化或自由化的趋势,还是马来西亚经济衰退所逼,这是马来西亚的一大突破,值得鼓励。非土著对此雀跃不已之余,还是抱着怀疑和谨慎的态度看待。 毕竟非土著在这40多年来一直封闭自固,一时间很难相信眼前所看到的一切。此外,国阵政府过去多年的政策朝令夕改,已经让国人麻木,不愿再期望过高,以免 期望越大,失望越大。
土著依旧保有12.5%股权
监管单位替土著利益把关
对 于土著而言,这是一个晴天霹雳的消息。这把保护土著近40年的伞,突然间被拔除了,难免让土著一时之间难以适从。自1971年起,纳吉父亲,也是马来西亚 第二任首相敦拉萨颁布的新经济政策(NEP),通过消除贫穷与重组社会结构两大目标,制定了30%的土著股权固打制,重新分别国家经济资源。
从那个时候起,马来西亚的经济就与土著保护政策挂钩,成了经济结构中不可切割的一环,并形成了马来西亚经济的特色。同一时候,扮演土著股权守护者的外资委员会(FIC)也在1974诞生,为这30%土著股权固打制把关。
这一切却在6月30日的“投资马来西亚”研讨会上,由纳吉亲手盖棺。纳吉在大会上宣布一系列的开放措施,包括淡化外资委员会的土著股权把关权力,并取消了上市公司30%土著股权固打制的政策。
更早之前,纳吉(左图)在4月份还分别宣布了废除27个次服务领域的30%土著股权,以及开放金融领域的外资股权限制(商业银行除外),将外资持股率从49%提高至70%。
如 果完全相信纳吉就此放弃土著保护政策,似乎过于乐观。从纳吉颁布的政策来看,土著股权政策并未烟消云散,只是以另一种形式生存下来。基本上,纳吉的开放政 策主要针对外资,土著权益依然受到一定程度上的保障。以上市公司为例,本地公司虽然无需再保持30土著股权制,但是,却必须在新的制度下,从25%公众持 股下保留12.5%的股权给土著。
这并不意味着,土著股权将只停留在12.5%。实际上,这12.5%的土著股权只是底线,实际股权可能更高。比方说,即使准备上市的公司已经符合12.5%的土著股权,但是,该公司在首次公开售股计划下,还是必须腾出12.5%的土著股权。
此外,虽然外资委员会的权限被淡化,但是,上市公司还是必须通过其他监管单位,包括国家银行、能源委员会、国家水务委员会等。即使是外资委员会,在某个程度上还是掌握最后的话语权。如果监管单位认为公司涉及国家利益等敏感领域,还是可以要求公司符合30%土著股权。
执行单位或阳奉阴违
结构性问题尚未解决
同时,纳吉在公布开放措施之际,只是从宏观角度出发,并没有检讨微观细节。这也可能导致土著股权制出现阳奉阴违的情况。比方说,政府部门在发出工程计划竞标时,还是存在土著股权制的色彩。这些工程一般上比较趋向于颁给那些拥有土著色彩的公司。
除此之外,纳吉也宣布成立一家总资金高达马币100亿元的国家股权公司(Ekuinas),其主要投资对象为土著非上市公司。这个私募基金是特别为土著设立的,专门用于扶持土著企业家所掌管的公司,以确保土著股权在整个经济大蛋糕中继续获得保障。
这基本上也是换汤不换药的做法。马哈迪之前提倡的“让土著精英来为广大土著保管经济利益”的政策,已经证明是一个失败之作。这个政策最终只是让一小撮马来人富裕起来,大部分马来人还是两袖清风。纳吉所成立的国家股权公司,显然还是延续这个政策,最终结果已可以预期。
更重要的是,陷入结构性问题的我国经济,已经来到十字路口。开放政策没有伴随经济结构的全面改革,以及人才的培训,最终只会在原地踏步。在人才凋零、经济僵化的环境下,拥有高科技、高附加价值的外资不会对马来西亚感兴趣,马来西亚最后只能继续停留在低价值链挣扎求存。
另一方面,在外交上,纳吉在上任之后的100天内,就风尘仆仆地官访了数个周遭国家,其中以中国和新加坡的意义最大。
需要中国资金救济
纳吉赶搭中国列车
第二任首相敦拉萨在70年代独排众异,在东盟国家中,率先与中国建交,为纳吉的外交之路打开了一道方便之门。借着重温敦拉萨走过之路,以友好关系官访中国的纳吉,趁机捞取了不少外交筹码。
同时,在全球经济陷入衰退之际,人口庞大,加上资金充裕,使得中国在这轮全球经济危机中依然屹立不倒。几乎所有国家都想着搭上中国这班列车,希望借此摆脱经济困境。
面对外资外逃,国内银行领域收紧银根马来西亚,当然也期望获得中国的青睐,将中国资金带回马来西亚。尤其是当我国政府为应付这轮经济危机,而拨出历史最大规模的经济刺激配套,导致国库空虚,财政赤字严重恶化之际,纳吉更需要中国资金的救济。
此 外,纳吉选择新加坡作为上任后首个官访的国家,旨在打破过去多年来因马哈迪与新加坡之间结下的恩怨所筑起的“柏林围墙”。当然,其部分背后原因,也是希望 能够吸引新国投资者,将资金投向柔佛州的依斯干达经济特区。柔佛州过去在经历经济危机时,依然能站稳脚步,全赖于新加坡人的消费能力,以及对产业市场的支 持。新国投资者的涌入,有助于带动产业市场的情绪,从而为我国创造更多的财富。
除了新加坡与中国,纳吉近日也分别与澳洲和韩国就经济、区域安全、科技等课题上,建立更密切的双边关系。
放 眼望去,中国、澳洲以及韩国都是东盟加六的成员国,很明显地,纳吉正在尝试重新建立马来西亚在东盟的地位。这个由马哈迪提倡,并发扬光大的组织,却在阿都 拉时代退居次要角色。纳吉能否让马来西亚再攀高峰,还需等待时间的证明。尤其是当其他成员国如印尼、越南等的快速崛起,马来西亚的光环已大不如前,前途挑 战更是艰巨。
明显地,纳吉要效仿其父亲敦拉萨一样,成为马来西亚在1969年种族冲突后,让国家回到正轨 的救世主,甚至如马哈迪般,在国际舞台上大放异彩。单凭这100天的政绩似乎言之过早。在度过了蜜月期后,真正的挑战才刚开始。纳吉要走的路,还很长。至 少在下一届大选来临之际,纳吉必须确保自己坐稳首相宝座。否则,这些努力只有让其继承人坐享其成了。

Salam
rakyat pekerja,
Globalisasi
telah membawa "manfaat" semu bagi sebagian masyarakat dalam
menggunakan produk-produk bermerk terkenal keluaran luar negeri. Saat
ini produk dengan merk-merk terkenal, seperti ADIDAS, NIKE, REEBOK,
GAP, dan lain sebagainya, semakin membanjiri pasar Indonesia. Bahkan
kecenderungan yang terjadi adalah orang akan sangat bangga ketika
menggunakan produk merk terkenal, karena tidak semua dapat membeli
dan menggunakan produk merk terkenal tersebut.

Dari
berbagai merk terkenal tersebut, sebagian diantaranya diproduksi atau
diolah di Indonesia. Untuk melakukan pengolahan produksi tersebut,
jelas perusahaan-perusahaan merk terkenal itu menggunakan buruh-buruh
dari Indonesia. Namun belum tentu kesejahteraan para buruh di
perusahaan merk terkenal tersebut dapat terpenuhi.

PT
Nike Indonesia menjadi contoh yang paling ideal untuk menjelaskan
keterpurukan buruh di perusahaan tersebut. Tentunya akan sangat aneh
ketika kita tahu, bahwa satu produk Nike dapat dijual dengan harga
yang sangat mahal, sementara buruh yang memproduksi produk tersebut
diupah dengan sangat rendah. Namun fakta itulah yang terjadi, dimana
seorang buruh di PT Nike Indonesia hanya diupah sebesar Rp 25.000,-
setiap harinya. Dalam laporan 2004, buruh Nike di Indonesia hanya
dibayar sekitar USD 2 per pasang sepatu dari harga sepasang sepatu
yang sebesar USD 75 – 200.
Selain
masalah upah, buruh PT Nike di Indonesia tidak memiliki jaminan
sosial. Hal ini tentunya sangat rentan bagi setiap pekerja, karena
dengan upah yang sangat murah, bisa dipastikan ia akan sangat
kesulitan untuk memenuhi kebutuhan-kebutuhan yang lainnya. Larangan
untuk berorganisasi bagi para buruhnya juga dilakukan oleh PT Nike
Indonesia, sehingga para buruh tidak dapat membela hak-haknya secara
kolektif. Pemberangusan terhadap organisasi buruh di PT Nike
Indonesia selalu terjadi di berbagai daerah.
Inilah
kebiadaban Kapitalisme yang telah benar-benar menyengsarakan
kehidupan para buruhnya. Jelas lah, bahwa Kapitalisme-Neoliberalisme
gagal dalam mensejahterakan rakyat pekerja. Karena sistem
Kapitalis-Neoliberal hanya akan menguntungkan para pemilik modal.
Kondisi
seperti ini pun akhirnya dibiarkan oleh pemerintahan kapitalis
sehingga kesengsaraan yang dialami oleh rakyat pekerja berlanjut
hingga hari ini. Tidak ada satupun para penguasa Indonesia, yang
selalu membela, melindungi, dan mempertahankan keajegan kapitalisme,
berupaya untuk mencegah terjadinya kesengsaraan pada rakyat pekerja.
Mereka bahkan berpihak kepada para pemilik modal dengan mempermudah

AG defends Cabinet's decision on inquest into MACC death

(My Sinchew) - KUALA LUMPUR:An inquiry by a Magistrate into the cause of death of Teoh Beng Hock under the Criminal Procedure Code (CPC) is the adequate recourse and appropriate venue for cases of this nature, the Attorney-General (AG) said Friday.

Tan Sri Abdul Gani Patail said with the CPC being a specific legislation that made provisions for a death inquiry, it was only proper that a Court of law determined the cause of death and related matters instead of a Royal Commission.

Holding a similar enquiry by the Royal Commission would be duplicating in such instance," he said in a three-page statement issued here Friday titled the "Death Inquiry Under the CPC in respect of the death of Teoh Beng Hock."

Earlier Friday, Prime Minister Datuk Seri Najib Tun Razak had said in Bangi that the AG would issue a statement and a detailed explanation on the matter.

Najib said this after being asked by the media on calls made by several groups for the formation of the royal commission to study the procedures concerning interrogation applied by the Malaysian Anti-Corruption Commission (MACC) to determine the cause of Teoh's death as well.

On the Royal Commission of Enquiry, Abdul Gani said thus far, the government had set up Royal Commission of Enquiry, among others, in relation to the tragedies at the Penang Ferry Terminal and Bright Sparklers Fireworks factory.

"Those were tragedies and disasters where many lives were lost due to negligence and non-compliance of operating procedures by the relevant authorities. None touched on the cause of death of a person," he said.

Abdul Gani said he had acted under Section 339 (1) of the CPC to direct the Magistrate to hold an inquiry into the death of Teoh, and the Magistrate is duty bound to hold an inquiry.

The Cabinet on Wednesday ordered an inquest next week to determine the cause of death of Teoh, whose body was found on July 16 on the fifth floor of Plaza Masalam, Shah Alam, which houses the Malaysian Anti-Corruption Commission (MACC) office on the 14th floor.

It also ordered the establishment of a royal commission of inquiry to study the standard operating procedures of the MACC in questioning witnesses.

The death of Teoh, 30, political aide to Selangor state executive councillor Ean Yong Hian Wah, raised public outcry after he was found dead following questioning as a witness by the MACC over alleged misuse of funds by certain state executive councillors in Selangor.

Abdul Gani also said the public must not be confused about the functions of the Royal Commission set up by the government with an inquiry under the CPC.

He said Section 2 of the Commissions of Enquiry Act 1950 clearly made reference to the enquiry into the conduct and management of government officers and departments or for public welfare.

"Therefore, it cannot be overstretched to cover an inquiry into the death of this nature, wherein an inquiry by the Magistrate under the Criminal Procedure Code is more appropriate and sanctioned by the law," he said.

He said the Royal Commission is rightly and lawfully formed for the purpose of enquiring into the procedural aspects of the Malaysia Anti-Corruption Commission in carrying out investigations.

"What is important is that we must abide by the Laws of the country. In all fairness, both the common interest of the Government and the public must be addressed.

"The inquiry under the Criminal Procedure Code necessitated by the Law and the enquiry under the Commission of Enquiry Act 1950 are the mechanisms to arrive at the truth in a fair and just manner.

"It will also address wholly all concerns raised by the Government and the public at large," added Abdul Gani.

Teoh's best man recalled by police

(Malaysian \mirror) - Woo Chuan Sing, a witness in the ongoing investigation into the death of Teoh Beng Hock was recalled by the police to have his statement recorded over discrepancies in a Malay daily news report.

Woo's lawyer, Lim Lip Eng, said his client told the media last Thursday that he last spoke to Teoh on the morning of July 15, when the political aide asked him over the telephone to be his best man for his wedding.

teoh-beng-hock.gif"However a report in a Malay daily quoted Woo as saying that he spoke to Teoh on July 16, the day he was found dead at Plaza Masalam," he told reporters after accompanying Woo to record his statement back at the Shah Alam district police headquarters, here today.

Lim said the police could have clarified their doubts over the phone instead of making his client return.

Last to contact Teoh

"The police did not call the reporter from the newspaper concerned to clarify the news facts," he said.

Woo, who was a good friend of Teoh during their student days in Universiti Kebangsaaan Malaysia, was among eight more people called by the police two days back to record their statements to assist the investigation into the death of Teoh, whose body was found on the corridor of the fifth floor of Plaza Masalam, Shah Alam, on July 16.

They were believed to be among the last persons to have had contact, either through SMS or phone calls, with Teoh before his body was found at 1:30pm on July 16, hours after he was questioned by the Malaysian Anti-Corruption Commission (MACC) over an alleged misappropriation of Selangor state funds.

Kemiskinan merupakan satu fenomena sosial yang barangkali belum ada formula saintifik yang dapat merungkai hingga ke akar umbi apa sebab sebenarnya terjadi masalah ini dalam dalam kehidupan manusia. Bersumberkan kepada nas dalam Al Quraan masalah kemiskinan adalah merupakan qadha dan qadar Allah keatas khalik ciptaannya.

Dengan itu jelaslah bahawa fenomena kemiskinan sosial itu tersirat falsafah kebesaran Tuhan dan amat sukar diinterprestasikan oleh akal manusia yang dangkal itu.Dari segi teori sosiologi kemiskinan itu dapat ditafsiirkan sebagai satu situasi serba kekurangan samada dari aspek keperluan asasnya seperti makanan, pakaian dan tempat berteduh.

Barangkali pendapat ahli sosiologi ini amat sesuai sebagai satu landasan penghujahan melihat masalah kemiskinan itu bermula daripada tercipatnya teori ilmiah sosiologi pada masa itu hinggalah ke abad kedua puluh.Ternyata intipati pemikiran yang cukuip kritis itu amatlah diperlukan oleh mereka ketika itu. Golongan ini menilai dan menkaji sejauh mana kekesanan idea mereka merungkai punca masalah sosial tersebut.

Ali .M.Rachman dalam bukunya bertajuk Masyarakat Kecil Dalam Era Global berpendapat bahawa kemiskinan itu adalah gaya hidup yang tumbuh dari intibudaya setiap masyarakat yang spesifik habitatnya di mana tradisi memahami ekosistem telah mendarah daging.Golongan masyarakat yang dihempit oleh bebanann kemiskinan yang lahir darpada habitat kehidupan memang wajar sekali diberi tumpuan adil dan saksama oleh pihak pemerintah.

Beberapa garis panduan yang dipetik dari sebuah buku bertajuk Proses Pembangunan Masyarakat susunan Patner Of Community Organisation, menyatakan bahawa pihak yang bertanggung jawab dalam menyusun semula masyarakat wajar mengambil kira apakah pembangunan tersebut mencapai sasarannya.Perlu dilihat apakah prisip dan ciri pembangunan masyarakat itu.Penekanan harus dibuat dalam kerja menganalisa isu utama krisis kemiskinan yang telah mendarah daging dalam kehidupan kelompok masyarakat itu?

Kemiskinannya perlu dicari dan dikesan dengan rasa tanggungjawab. Kerja harus berlandaskan sifat kebajikan dan ehsan dengan slogan utamakan golongan miskin Pihak yang terlibat secara langsung atau tidak langsung dalam kerja-kerja kebajikan kepada masyarakat itu perlu dibuat penuh keiklasan supaya golongan sasar tersebut dapat keluar daripada kepompong kemiskinan yang membelenggu kehidupan mereka turun-temurun.

Persoalannya sekarang,bagaimana mengukur tahap kemiskinan?.Tahap kemiskinan barangkali boleh dilihat dari segi alam sekelilingnya.Penilaian tahap kemiskinan mungkin terjemahan daripada situasi persikataran yang serba kekurangan.Kelompok sasar dilihat tidak memiliki eset asas seperti tanah,rumah usang dan tidak mempunyai kemudahan bekalan elektrik dan air paip.Golongan inilah yang ditakripkan sebagai miskin tegar.

Dr.S..Hussin Ali dalam bukunya Kemiskinan dan Kelaparan di Kelantan mengariskan dua faktor utama menjadi ukuran kemiskinan iaitu pertama keadah mutlak dan kaedah perbandingan.Pengukur kemiskinan menurut kaedah mutlak ialah melihat dari segi pendapatan.Jumlah pendapatan adalah pemisah dan membeza tahap kemiskinan.Dalam merujuk kes ini sebagai contoh pendapatann RM.7000 setahun yang bersamaan purata pendapatan sabulan RM. 600 ratus, jumlah ini masih diklasifikasikan sebagai golongan miskin.
Golongan yang dikategori seperti ini disenaraikan sabagai miskin mutlak.Pengukur kemiskinan kedua dibuat secara perbandingan tara.Dr.S.Hussin meghuraikan perbandingan kes kemiskinan seperi berikut;"Perbandingan kemiskinan dalam satu-satu masyarakat biasanya dikaitakan dengan struktur susun lapis masyarakat dan perbezaan atau ketidak saksamaan ekonomi yang dijelmakan"

Mengiikut statistic Kementerian Pembangunan Luar Bandar dan Wilayah Malaysia seramai 48,134 Ketua Isi Rumah Termiskin di Sabah setakat ini.Ini merupakan satu angka besar dan memerlukan perhatian serius pihak kerajaan untuk mencari langkah bjjaksana dan mesra masyaraka untuk mengatasi masalah itu.

Tidak hairanlah negeri ini telah dikategorikan negeri termiskin di Malaysia.Ini merupakan satu cabaran bagi kerajaan Sabah itu sendiri dan menutut satu penelitian dan kajian dasar kerajaan melalui agensi-agensi dipertanggungjawab membasmi kemiskinan.

Daerah Kota Belud adalah daerah diistiharkan termiskin di Malaysia.Apakah benar daerah itu daerah termiskin? Persoalan itu perlu ditanya kembali kerana kita perlu tahu dari sudut mana penilaian kemiskinan itu dibuat Lapangan kajian dan pemerincian skop kajian dan penilaian masyarakat Kota Belud perlu diperjelaskan kepada umum dari segi mana masalah kemiskinan itu dilebalkan kepada masyarkat Kota Belud.

Kalaulah benar apakah pelan tindakan telah dibuat oleh para pemimpin tempatan di daerah ini untuk mengetasi isu tersebut.Mungkin ada juga kewajaran pemikiran Ali.M.Rachman yang menekankan sikap dan gaya hidup masyarakat itu yang sukakan budaya kemiskinan terus melingkari kehidupan ,tak mahu menerima kemajuan dan pembangunan .

Jika inilah berlaku adalah amat sukar mengubah kehidupan sesuatu kolompok masyarakat itu dan terjadilah istilah kemiskinan itu mendarah daging dalam kehidupan turun temurun.

开放表层覆盖土著保护政策 纳吉未解决经济结构性问题

【本刊特约梁文志】眨眼间,首相纳吉已上任100天。凭心而论,在这短短的100天以来,纳吉的确交出了一些成绩单。当然,这当中有褒有贬。在这里,我稍微简单总结一下纳吉的施政方向:纳吉巧妙地避开了最弱的政治那一环,专攻经济与外交两大方向,在国内外建立起自己的地位与威望。
纳吉选择经济与外交,而非政治,作为立足之点,显然有其考量因素。经济上,全球经济危机的爆发,为纳吉创造了一个天时地利人和的契机,将本身打造成一个把经济从崩溃边缘救回的救世主。
外 交上,曾经在其父亲敦拉萨与马哈迪领导下攀上巅峰的马来西亚,却在阿都拉时代逐步退色。纳吉借尸还魂,在已扎稳的外交地位上,大打外交牌,树立本身在国际 和区域间的鲜明形象。由于炸尸案和霹雳州夺权等道德问题令他形象大损、坠入窘境,因此比较起政治,经济与外交两大筹码更能有效地建立纳吉的威望。
从经济层面来看,纳吉在上位的100天内,就为马来西亚带来了过去近40年来从来不曾出现过的重大改变:打开潘多拉宝盒,废除了捆绑多年的土著扶持政策,并将全面自由化与开放市场的政策释放出来。
不 管是基于全球化或自由化的趋势,还是马来西亚经济衰退所逼,这是马来西亚的一大突破,值得鼓励。非土著对此雀跃不已之余,还是抱着怀疑和谨慎的态度看待。 毕竟非土著在这40多年来一直封闭自固,一时间很难相信眼前所看到的一切。此外,国阵政府过去多年的政策朝令夕改,已经让国人麻木,不愿再期望过高,以免 期望越大,失望越大。
土著依旧保有12.5%股权
监管单位替土著利益把关
对 于土著而言,这是一个晴天霹雳的消息。这把保护土著近40年的伞,突然间被拔除了,难免让土著一时之间难以适从。自1971年起,纳吉父亲,也是马来西亚 第二任首相敦拉萨颁布的新经济政策(NEP),通过消除贫穷与重组社会结构两大目标,制定了30%的土著股权固打制,重新分别国家经济资源。
从那个时候起,马来西亚的经济就与土著保护政策挂钩,成了经济结构中不可切割的一环,并形成了马来西亚经济的特色。同一时候,扮演土著股权守护者的外资委员会(FIC)也在1974诞生,为这30%土著股权固打制把关。
这一切却在6月30日的“投资马来西亚”研讨会上,由纳吉亲手盖棺。纳吉在大会上宣布一系列的开放措施,包括淡化外资委员会的土著股权把关权力,并取消了上市公司30%土著股权固打制的政策。
更早之前,纳吉(左图)在4月份还分别宣布了废除27个次服务领域的30%土著股权,以及开放金融领域的外资股权限制(商业银行除外),将外资持股率从49%提高至70%。
如 果完全相信纳吉就此放弃土著保护政策,似乎过于乐观。从纳吉颁布的政策来看,土著股权政策并未烟消云散,只是以另一种形式生存下来。基本上,纳吉的开放政 策主要针对外资,土著权益依然受到一定程度上的保障。以上市公司为例,本地公司虽然无需再保持30土著股权制,但是,却必须在新的制度下,从25%公众持 股下保留12.5%的股权给土著。
这并不意味着,土著股权将只停留在12.5%。实际上,这12.5%的土著股权只是底线,实际股权可能更高。比方说,即使准备上市的公司已经符合12.5%的土著股权,但是,该公司在首次公开售股计划下,还是必须腾出12.5%的土著股权。
此外,虽然外资委员会的权限被淡化,但是,上市公司还是必须通过其他监管单位,包括国家银行、能源委员会、国家水务委员会等。即使是外资委员会,在某个程度上还是掌握最后的话语权。如果监管单位认为公司涉及国家利益等敏感领域,还是可以要求公司符合30%土著股权。
执行单位或阳奉阴违
结构性问题尚未解决
同时,纳吉在公布开放措施之际,只是从宏观角度出发,并没有检讨微观细节。这也可能导致土著股权制出现阳奉阴违的情况。比方说,政府部门在发出工程计划竞标时,还是存在土著股权制的色彩。这些工程一般上比较趋向于颁给那些拥有土著色彩的公司。
除此之外,纳吉也宣布成立一家总资金高达马币100亿元的国家股权公司(Ekuinas),其主要投资对象为土著非上市公司。这个私募基金是特别为土著设立的,专门用于扶持土著企业家所掌管的公司,以确保土著股权在整个经济大蛋糕中继续获得保障。
这基本上也是换汤不换药的做法。马哈迪之前提倡的“让土著精英来为广大土著保管经济利益”的政策,已经证明是一个失败之作。这个政策最终只是让一小撮马来人富裕起来,大部分马来人还是两袖清风。纳吉所成立的国家股权公司,显然还是延续这个政策,最终结果已可以预期。
更重要的是,陷入结构性问题的我国经济,已经来到十字路口。开放政策没有伴随经济结构的全面改革,以及人才的培训,最终只会在原地踏步。在人才凋零、经济僵化的环境下,拥有高科技、高附加价值的外资不会对马来西亚感兴趣,马来西亚最后只能继续停留在低价值链挣扎求存。
另一方面,在外交上,纳吉在上任之后的100天内,就风尘仆仆地官访了数个周遭国家,其中以中国和新加坡的意义最大。
需要中国资金救济
纳吉赶搭中国列车
第二任首相敦拉萨在70年代独排众异,在东盟国家中,率先与中国建交,为纳吉的外交之路打开了一道方便之门。借着重温敦拉萨走过之路,以友好关系官访中国的纳吉,趁机捞取了不少外交筹码。
同时,在全球经济陷入衰退之际,人口庞大,加上资金充裕,使得中国在这轮全球经济危机中依然屹立不倒。几乎所有国家都想着搭上中国这班列车,希望借此摆脱经济困境。
面对外资外逃,国内银行领域收紧银根马来西亚,当然也期望获得中国的青睐,将中国资金带回马来西亚。尤其是当我国政府为应付这轮经济危机,而拨出历史最大规模的经济刺激配套,导致国库空虚,财政赤字严重恶化之际,纳吉更需要中国资金的救济。
此 外,纳吉选择新加坡作为上任后首个官访的国家,旨在打破过去多年来因马哈迪与新加坡之间结下的恩怨所筑起的“柏林围墙”。当然,其部分背后原因,也是希望 能够吸引新国投资者,将资金投向柔佛州的依斯干达经济特区。柔佛州过去在经历经济危机时,依然能站稳脚步,全赖于新加坡人的消费能力,以及对产业市场的支 持。新国投资者的涌入,有助于带动产业市场的情绪,从而为我国创造更多的财富。
除了新加坡与中国,纳吉近日也分别与澳洲和韩国就经济、区域安全、科技等课题上,建立更密切的双边关系。
放 眼望去,中国、澳洲以及韩国都是东盟加六的成员国,很明显地,纳吉正在尝试重新建立马来西亚在东盟的地位。这个由马哈迪提倡,并发扬光大的组织,却在阿都 拉时代退居次要角色。纳吉能否让马来西亚再攀高峰,还需等待时间的证明。尤其是当其他成员国如印尼、越南等的快速崛起,马来西亚的光环已大不如前,前途挑 战更是艰巨。
明显地,纳吉要效仿其父亲敦拉萨一样,成为马来西亚在1969年种族冲突后,让国家回到正轨 的救世主,甚至如马哈迪般,在国际舞台上大放异彩。单凭这100天的政绩似乎言之过早。在度过了蜜月期后,真正的挑战才刚开始。纳吉要走的路,还很长。至 少在下一届大选来临之际,纳吉必须确保自己坐稳首相宝座。否则,这些努力只有让其继承人坐享其成了。

AG's explanation "misleading"

We know that there are such provisions for setting up an inquests. But the AG is missing the point that all such inquiries into deaths in custody have failed to identify the perpetrators and achieve any just outcome. No one has been held responsible for any of the deaths in custody since 2003.

These inquests failed for a variety of reasons. Junior judicial officers were investigating where they were entirely dependent on the evidence placed before them through police witnesses, when the core issue was often police misconduct itself. Rules of evidence were technical and the participation of lawyers also limited.

The failure of the inquests had underlined the call for the IPCMC in the 2005 Report of the Royal Commission to Enhance the Operation and Management of the Police, so that an independent body would investigate such misconduct.

It is the failure of these inquests that fuelled the strong public outcry for a Royal Commission into the cause of Teoh's death. The announcement in the media today that a Deputy Registrar of the Shah Alam High Court, Azmil Muntapha Abas, has been appointed as the coroner also goes to reinforce the point we are making.

With no disrespect, Azmil's standing is not comparable to the personalities who were appointed to the Royal Commission to investigate the assault on Datuk Seri Anwar Ibrahim and identify the assailants, such as former Chief Judge of Malaya Tan Sri Anuar Zainal Abidin, and retired Court of Appeal Judge Datuk Mahadev Shankar.

It was also misleading for the AG to refer to the Commissions of Enquiry Act 1950 to imply that royal commissions were for the purpose of inquiring into "conduct and management of government officers and departments, or for the public welfare".

Such inquiries can also be made into crimes committed by government officers or departments, such as the aforementioned inquest set up in January 1999 to investigate the assault on Anwar and to identify his assailant.

It would have been appropriate if, as legal adviser to the government, the AG had advised the cabinet to broaden the terms of reference of the Royal Commission to include investigating the circumstances of Teoh's death and identifying those responsible, [on top of scrutinising the mode of questioning employed by the Malaysian Anti-Corruption Commission (MACC) and the cause of Teoh's death].

Instead, we have the hastily set-up 15-day inquest that has been directed to start tomorrow. It will only confirm for all Malaysian that the government does not intend for the Royal Commission to touch on the circumstances of Teoh's death at all.

Of the two issues at hand, it is the MACC's method of interrogation that has riled up national anger. Concerned citizens want the truth about how a young man about to be married to a woman pregnant with his child entered the MACC office and wound up dead.

The cabinet might have misread public sentiment when they decided on the Royal Commision's narrow and ineffectual terms of reference. The commission has much greater moral authority and legal prowess to probe into Teoh's death and dig out the truth from behind the veil of Malaysian officialdom. To relegate this critical task to a junior magistrate court of inquest opens the Barisan Nasional government to the Pakatan Rakyat (PR) charge that the cabinet has put the cart before the horse.

Already, Teoh's death has reunited the PR and rescued them from their receding image damaged by public internal bickering and their poor showing at the Manik Urai by-election. Mishandling of the investigation into causes of Teoh's death will only give them an opportunity to accumulate their political capital towards the next general election.

Salam
rakyat pekerja,
Paradigma
kepolisian sebagai pengayom dan pelindung masyarakat ternyata masih
belum sepenuhnya dapat dijalankan oleh aparat kepolisian di
Indonesia. Kepolisian yang seharusnya dapat menjadi sandaran bagi
masyarakat umum untuk menegakkan hukum dan menghormati segala bentuk
Hak Asasi Manusia, terkadang justru sebaliknya, mereka sendirilah
yang melakukan tindakan kekerasan terhadap masyarakat. Arogansi
kepolisian dalam menangani sebuah kasus yang melibatkan rakyat
pekerja terkadang tidak mengindahkan aturan-aturan yang berlaku, yang
seharusnya menjadi panduan dan pegangan bagi setiap aparat
kepolisian.
Hal
ini terbukti dengan terjadinya tindak kekerasan terhadap para pekerja
LBH Jakarta yang berusaha mendampingi saksi yang masih berusia di
bawah umur dalam kasus pembunuhan Fahri. Pada tanggal 27 Juli 2009, W
(14 tahun) dan N (21 tahun), yang statusnya sebagai saksi dalam kasus
tersebut, harus menjalani pemeriksaan hingga jauh malam di markas
POLRES Jakarta Utara. Permintaan pihak LBH Jakarta untuk menghentikan
proses BAP pada pukul 11.00, dengan alasan saksi harus sekolah, dan
kemudian meminta penjadwalan ulang pemeriksaan pun ditolak oleh pihak
kepolisian. Hal ini jelas merupakan pelanggaran terhadap fair
trial dan hak-hak saksi. Selain itu, perlakuan aparat kepolisian
tersebut juga telah melanggar Konvensi Anak (CRC) dan UU No 23 tahun
2002 tentang Perlindungan Anak.
Karena
permintaan pihak LBH Jakarta yang mendampingi saksi tersebut, maka
akhirnya pihak LBH Jakarta yang bernama Tommy Albert Tobing
(Pengacara Publik) dan M Haris Barkah (Asisten Pengacara Publik) juga
harus ditahan karena dianggap telah menghalangi pemeriksaan terhadap
saksi. Hal ini jelas tidak masuk akal, karena LBH Jakarta hanya
berusaha untuk melindungi hak-hak W dan N sebagai saksi dan
memberikan kesempatan mereka untuk mengenyam pendidikan sebelum
kembali diperiksa. Penahanan terhadap saksi tersebut juga menjadi
sangat aneh, karena sebenarnya status hukum mereka sebenarnya
hanyalah saksi.
Karena
terjadi penahanan terhadap pekerja LBH Jakarta, maka pimpinan LBH
Jakarta beserta beberapa orang staffnya mendatangi POLRES Jakarta
Utara untuk meminta penjelasan mengenai dasar penahanan pekerja LBH
Jakarta. Pihak kepolisian pun tidak mampu menjelaskan status hukum
penahanan pekerja LBH Jakarta tersebut. Setelah beberapa lama
bernegosiasi dengan pihak kepolisian POLRES Jakarta Utara, pimpinan
LBH Jakarta beserta staffnya diusir dari POLRES Jakarta Utara dengan
alasan Kapolres hendak istirahat dan pemeriksaan akan dilakukan esok
hari pada tanggal 28 Juli 2009. Alasan tersebut jelas tidak dapat
diterima oleh pihak LBH Jakarta karena dengan begitu seharusnya saksi
dan pekerja LBH Jakarta dapat dibebaskan dan dapat datang kembali
keesokan harinya. Namun permintaan untuk melepas saksi dan pekerja
LBH Jakarta tersebut dibalas dengan tindakan kekerasan oleh pihak
Kepolisian Jakarta Utara, sehingga menyebabkan Asfinawati (Direktur
LBH Jakarta) terjatuh akibat didorong punggungnya. Kejadian ini pun
sebenarnya disaksikan oleh pihak SPK dan Provost dari POLRES Jakarta
Utara, namun mereka tidak melakukan tindakan apa pun, bahkan mereka
mendiamkan perilaku yang dilakukan oleh pihak kepolisian, khususnya
Wakasat POLRES Jakarta Utara.
Pihak
LBH Jakarta pun kemudian menghubungi Komisioner Komisi Kepolisian
Nasonal (KOMPOLNAS), Pandupraja, untuk datang ke POLRES Jakarta Utara
pada dini hari tersebut, untuk bertemu dengan Kasatreskrim POLRES
Jakarta Utara yang diketahui masih di ruangannya pada saat itu. Namun
Komisioner KOMPOLNAS tersebut dihadang oleh anggota Provost yang
berjaga dan tidak diperbolehkan untuk menemui Kasatreskrim POLRES
Jakarta Utara.
Tindakan
dari pihak aparat dan pimpinan POLRES Jakarta Utara tentu saja
merupakan tindakan arogansi yang ditunjukkan pada rakyat pekerja.
Dalam hal ini, aparat dan pimpinan POLRES Jakarta Utara telah
melakukan pelanggaran fair trial, hak-hak saksi, hak atas
bantuan hukum, konvensi anak, UU No 23 tahun 2002 tentang
perlindungan anak, serta hak setiap orang atas bantuan hukum. Selain
itu, tindakan kriminalisasi terhadap Tommy Albert Tobing dan Haris
Barkah merupakan serangan dan ancaman terhadap eksistensi pekerja
bantuan hukum dan pembela hak asasi manusia. Peraturan Kapolri No 8
tahun 2009 tentang Implementasi Standard dan Prinsip-prinsip HAM
dalam pelaksanaan tugas Kepolisian Republik Indonesia, yang baru saja
diterbitkan, ternyata langsung dilanggar oleh aparat dan pimpinan
POLRES Jakarta Utara. Hal ini kembali menegaskan pihak kepolisian,
khususnya POLRES Jakarta Utara, masih terjebak dalam paradigma lama
yang memakai cara-cara kekerasan dan arogan dalam menangani menangani
kasus-kasus yang melibatkan rakyat pekerja.
Tindakan
arogan ini tentu saja biasanya hanya ditunjukkan kepada para rakyat
pekerja. Seolah-olah rakyat pekerja tidak memiliki hak-hak yang
seharusnya dijunjung tinggi oleh pihak kepolisian sebagai pengayom
dan pelindung masyarakat. Sementara perlakuan berbeda akan didapatkan
jika pihak kepolisian memeriksa para pemilik modal yang jelas-jelas
telah menyengsarakan rakyat pekerja di Indonesia. Hal ini kemudian
menunjukkan keberpihakan pihak kepolisian terhadap para pemilik modal
dan mendiskriminasikan rakyat pekerja dalam menangani berbagai kasus.
Kepolisian memang sejak lama telah menjadi alat pelindung para
kapitalis dalam melancarkan agenda-agenda Neoliberalisme di
Indonesia. Bahkan untuk melindungi dan memastikan berjalannya
agenda-agenda Neoliberalisme, kadang kala pihak kepolisian tidak
segan-segan menggunakan tindakan kekerasan terhadap rakyat pekerja
yang berusaha melindungi hak-haknya.
Maka
dari itu, kami dari Perhimpunan Rakyat Pekerja (PRP) menyatakan
sikap:

Mengecam keras tindakan arogansi dan
kekerasan yang dilakukan oleh aparat dan pimpinan POLRES Jakarta
Utara pada saksi kasus pembunuhan Fahri dan para pekerja LBH
Jakarta.

Menuntut pada Kepala Kepolisian RI
untuk menindak tegas Kapolres Jakarta Utara, Wakapolres Jakarta
Utara, Kasatreskrim POLRES Jakarta Utara, dan Wakasatreskrim POLRES
Jakarta Utara sebagai orang-orang yang bertanggungjawab langsung
terhadap seluruh pelanggaran-pelanggaran diatas.

Mendesak Kepolisian Republik Indonesia
untuk mematuhi dan menjunjung tinggi Hak Asasi Manusia serta
aturan-aturan yang berlaku, sehingga hak-hak korban dan saksi serta
pendamping bantuan hukum dapat dipenuhi hak-haknya.

Kapitalisme-Neoliberalisme telah gagal
dalam mensejahterakan dan melindungi hak-hak rakyat pekerja, maka
hanya dengan SOSIALISME lah kepentingan rakyat pekerja akan
terlindungi dalam mencapai kesejahteraan.

SHAH ALAM 29 Julai - Peguam pemerhati kepada keluarga mendiang Teoh Beng
Hock, Gobind Singh Deo berkata, dia tidak mengetahui siapa dua individu
yang enggan memberikan sampel ujian asid dioksiribonukleik (DNA) bagi
membantu siasatan kes kematian Setiausaha Politik Exco Selangor itu yang
ditemui mati pada 16 Julai lalu.

Menurut Gobind, dia sebaliknya hanya membuat andaian salah seorang
daripada mereka itu dikenalinya kerana memaklumkan kepadanya hari ini
dia telah dipanggil ke balai.

"Saya tak tahu siapa mereka ini. Saya hanya boleh membuat andaian kerana
dua orang datang berjumpa saya hari ini dan memberitahu bahawa mereka
disuruh ke balai.

"Seorang daripada mereka adalah Ahli Majlis Perbandaran Kajang, Tan Boon
Wah, tetapi seorang lagi saya tak kenal," katanya kepada pemberita
ketika ditemui selepas prosiding inkues mendiang Beng Hock di Mahkamah
Majistret di sini hari ini.

Gobind yang juga Ahli Parlimen Puchong diminta mengulas keterangan
peguam cara, Tan Hock Chuan dalam prosiding inkues itu hari ini yang
memberitahu, dua individu enggan memberikan sampel mereka untuk tujuan
analisis DNA.

Hock Chuan sebelum itu memberitahu, seramai 102 orang telah diambil
spesimen mereka bagi membantu siasatan kematian Beng Hock.

Dalam pada itu, Utusan Malaysia difahamkan, selain Boon Wah (yang
diandaikan oleh Gobind), seorang lagi yang enggan memberikan sampel DNA
kepada polis ialah perunding sebuah syarikat pembinaan.

Menurut satu sumber, keengganan kedua-dua individu itu setelah mereka
dinasihatkan oleh peguam masing-masing.

Sementara itu, pekarangan Mahkamah Majistret di sini sesak dengan orang
ramai yang ingin mengikuti prosiding inkues kematian Beng Hock yang
bermula hari ini.

Kira-kira 150 petugas media daripada pelbagai organisasi dan puluhan
peguam serta ahli politik turut membanjiri pekarangan mahkamah itu.

Para petugas media tiba di mahkamah seawal pukul 6 pagi dan hanya
dibenarkan masuk ke dalam mahkamah kira-kira pukul 8.30 pagi setelah
memperoleh pas kebenaran.

Tinjauan Utusan Malaysia di luar pekarangan mahkamah hari ini mendapati
keadaan tenang dan terkawal tanpa insiden yang tidak diingini.

Turut mengikuti prosiding tersebut ialah ahli keluarga mendiang iaitu
bapanya, Teoh Leong Hwee, abangnya, Beng Kee, adik perempuannya, Lee
Lan, dan tunangnya, Soh Cher Wei yang hadir ke mahkamah kira-kira pukul
8.05 pagi.

Tan Boon Hwa, ahli majlis perbandaran Kajang dan Lee Wye Wing, Techical
Advisor, WSK Services menolak memberi sample DNA kepada pihak polis
forensik untuk membantu siasatan punca kematian mendiang Teoh Beng Hock.

Kedua-dua mereka menolak pemberian sample DNA setelah dinasihatkan oleh
peguam DAP, Gobind Singh Deo.


Difahamkan kedua-dua mereka adalah saksi yang disoalsiasat oleh SPRM
pada tarikh yang sama Teoh dipanggil hadir ke pejabat SPRM, Plaza
Masalam.

Persoalannya, kenapa peguam DAP menasihatkan mereka agar jangan beri
sample DNA untuk membantu siasatan sedangkan DAP sebelum ini
bersungguh-sungguh menggesa kerajaan mempercepatkan siasatan untuk
mencari siaakah pembunuh mendiang Teoh ?

Persoalan kedua, kenapa Gobind meminta semua dokumen yang berkaitan
dengan kematian mendiang dan meminta penangguhan mahkamah, tempoh 10
hari untuk meneliti semua dokumen-dokumen itu ?

Gobind Singh Deo adalah anak Karpal Singh (Pengerusi DAP Pusat). Beliau
juga merupakan peguam pemerhati keluarga mediang Teoh dan peguam
pemerhati mewakili DAP. Gobind juga merupakan ahli parlimen DAP bagi
kawasan Puchong.

Looking beyond racial lines

“To claim that the Chinese are masters is a complete lie, extremely mischievous and calculated to arouse the Malays,” said Professor Lim Teck Ghee.

That was the succinct reply of the former director of the Center for Public Policies Studies (CPPS) to Tun Dr Mahathir Mohamad's recent blog entry in which he alluded that the non-Malays, in particular the Chinese, were the real masters of Malaysia's economy.

“After 39 years of being implemented, the division of corporate wealth to them (bumiputeras) is only 20%, whereas other races have 50%, even though they represent 26% of the total population,” wrote Mahathir in his blog post Kaki Dalam Kasut on July 20.

His comments generated a wave of disgruntled blog entries among Malaysian bloggers, including political analyst Khoo Kay Peng, who called Mahathir out on having played a role in allowing the ascendancy to power by certain individuals.

Dr M's controversial comments over the ownership of bumiputera equity has drawn condemnation from all quarters, including Barisan Nasional component parties, with both MCA and Gerakan calling them baseless and a threat to Malaysia's racial harmony.

MCA secretary-general Senator Datuk Wong Foon Meng said by equating the liberalisation of Malaysia's affirmative action policies as taking over "something from the Malays is also to have an outdated mindset of a zero sum game".

Gerakan Youth deputy chairman Oh Tong Keong on the other hand said Dr M had “only made statements and presumptions and (has) not given any reasons for them”.

He also pointed out that Mahathir appeared to have forgotten that he oversaw 28 years of New Economic Policy's (NEP) implementation of the 39 years it had been enforced.

Lim, who is now adjunct professor at UCSI University, told The Edge Malaysia that Dr M’s statement displayed elements of “ultra-nationalism and fascism”.

“In fact, the Malays have done very well for themselves. If what Dr M says is to be taken up, there should be a proper analysis of it and he should be made to explain further how he reached that conclusion.”

Mahathir's remarks that only 20% of corporate wealth is owned by bumiputeras stems from the government's stance on the matter, which was brought up in 2006 when a study carried out by CPPS, under the Asian Strategy and Leadership Institute (Asli), estimated bumiputera equity ownership to be about 45% – well above the 30% target that NEP was meant to achieve.

The CPPS findings are also supported by a study carried out by Dr M Fazilah Abdul Samad from Universiti Malaya.

In her 2002 report, “Bumiputeras in the corporate sector: Three decades of performance 1970-2000”, she revealed that the 30% bumiputera equity ownership target was reached in 1997.

“Dr M is manipulating and distorting the figures again,” said Lim. “No one really believes that line, and the fact that they've now opened up the economy means that I've been vindicated.”

The controversial findings of the CPPS had cost Lim his position in CPPS as he resigned soon after in defense of his findings.

Tun Abdullah Ahmad Badawi, the then-prime minister, disputed Lim's findings, saying that they were inaccurate and had the potential to incite anger among non-bumiputeras in the country.

“If you conduct a survey, you would discover that only 13% was bumiputera-owned, with some 60% owned by non-bumiputeras,” he told The Star in October 2006 in response to the criticisms that the government's figures of equity ownership did not take into account GLCs.

Other criticisms of the government's stance were that it was based on par value, because it is an arbitrary figure, as opposed to market value, which is a recognised valuation.

Par value is understood as the face value of a bond, or the amount assigned to a security when representing the value contributed for each share in cash or goods. Consequently, par value varies and ranges from company to company.

Class, not race
Mahathir's comments came at a time when Malaysia, under Prime Minister Datuk Seri Najib Razak, is moving towards a more liberalised economy, and appears to be undoing key components of the NEP that Mahathir strengthened during his premiership.

This includes the abolishment of the 30% bumiputera quota rule across 27 service sub-sectors announced on April 22, which was followed by the announcement on June 30 that the 30% bumiputera stock allocation under initial public offerings (IPOs) would be reduced to 12.5%, and done away with if the takeup rate among bumiputeras was low.

These measures are baby steps towards a reversal of the NEP that Mahathir had overseen for 28 years. It is little wonder that the former premier, noted for his sharp tongue, is critical of these liberalisation measures.

Political analyst at Monash University Sunway Wong Chin Huat, who also has a background in economics, feels that Mahathir’s statements had less to do with economics than it had to do with politics.

“Mahathir feels ignored. He has praised the Chinese many times in the past; but his position on issues changes when his position in the political structure changes,” said Wong.

He added that Mahathir would disagree on any aspect of a policy that would “contradict his wisdom or exclude him in the inception or implementation of the policy”, even if the steps were economically viable.

On why Dr M was not consulted by Najib, Wong remarked: “I suppose everyone wants to be their own boss.”

Najib had in the past often taken steps to appease Mahathir, such as appointing his son Mukhriz as the deputy minister in the powerful Ministry of International Trade and Industry in lieu of Abdullah’s son-in-law Khairy Jamaluddin.

However, in recent times, the country has seen Dr M expressing his dissatisfaction of Najib’s steps over the economy and the scrapping of the language policy for the teaching and learning of science and mathematics in English (PPSMI).

Looking forward
Najib's new measures, which reduces the racial aspect of the country's economic policy, has struck a chord with many Malaysians.

In a poll carried out by Merdeka Center, 62% of the 1,062 respondents approved of the liberalisation measures and 60% believed it would help Malays in the long term.

Najib's overall approval rating had also improved from 40% when he first took office, to 65% in July after his first 100 days in office.

These include the reformation of education policies to produce a new generation of knowledgeable and competent graduates, desired by foreign companies.

Lim said these liberalization moves should have been put in place two decades ago.

“It is not too late,” he said. “Najib has the potential to be a good leader. The NEP has outlived its purpose, and now it’s time to open up the economy. If he doesn’t, it could cost him his job.”

Veteran MIC leader joins Anwar's team

(Malaysian Mirror) - MIC leaders are not overly concerned that one of its former vice-presidents has defected to the opposition PKR today. For S Samy Vellu and his people, SS Subramaniam has ‘retired’and no longer active in politics.

For PKR supremo Anwar Ibrahim however, Subramaniam’s entry into his party is a major coup and ‘good news’ for the Indian community in the country.

As for the defector himself, SS Subramaniam didn’t make much of his joining PKR except to hope that the new party he has just embraced would fulfill his dream of uniting Malaysians of all races.

Subramaniam, in his early seventies, was welcomed by Anwar and other PKR leaders into the party at a ceremony here today. The defector also announced at the function that he would bring in some 2,000 MIC members into PKR and that 12 MIC branches in the party would close.

In his brief address, Subramaniam revealed that he has been a supporter of Anwar and his policies for a long time.

“I believe that a multi-racial party like PKR will be able to fight for all races in the country,” he said.

'Samy caused division among Indians'

Hsamy-vellu.pnge also took a pot shot at Samy Vellu, claiming that the MIC president was responsible for the wide division in the Indian communities and that he (Samy) has outlived his usefulness.

Subramaniam has served one term as MP for Segamat and is also a former state assemblyman for Bukit Raja. His most senior public post was as parliamentary secretary to the old Ministry of Trade and Industry (now renamed Ministry of International Trade and Industry).

Several MIC branch leaders in Petaling Jaya also announced at the function that they were dissolving their branches.

For Anwar and PKR, they had another ‘good news’ a week ago when former MCA strongman Chua Jui Meng joined the party.

Other prominent BN leaders who recently joined PKR are former Gerakan veep Dr Tan Tee Kwong and former deputy MCA Wanita leader Dr Tan Yew Kew. Both had previously served in the Cabinet.

Chua Jui Meng is also a former health minister.

Apa status kes 54 Adun BN Selangor habiskan RM 27 juta?

(Harakah) - Jaraknya tidak sampai setahun selepas peristiwa kematian A.Kugan semasa di dalam tahanan polis, rakyat sekali lagi dikejutkan dengan tragedi ngeri kematian misteri Setiausaha Politik Exco Kerajaan Negeri Selangor, Teoh Beng Hock.

Beng Hock dilaporkan ditemui mati di koridor luar tingkat lima bangunan plaza Masalam di Shah Alam selepas disoal siasat Suruhanjaya Pencegahan Rasuah (SPRM) berhubung isu penyalahgunaan wang peruntukan melibatkan beberapa Adun Pakatan Rakyat negeri Selangor.

Tragedi tersebut menggamit pelbagai persepsi tidak menyenangkan terhadap pihak berkuasa tempatan. Di mana piagam kerajaan dalam menjamin keselamatan suspek semasa menjalani proses siasatan?

Apatah lagi siasatan ke atas Beng Hock dilihat agak luar biasa apabila memakan masa terlalu lama (kira-kira 10 jam). Modus operandi itu secara tidak langsung menimbulkan unsur penderaan mental sekaligus bersalahan dengan etika hak asasi manusia.

Justeru, tidak ada cacatnya desakan agar Suruhanjaya Diraja ditubuhkan kerana tragedi tersebut memberi kesan besar kepada iltizam rakyat yang ingin melihat sesuatu perkara itu dari sudut keadilan.

Tindakan mengunci suara mana-mana individu yang cuba melontarkan pandangan atau pendapatnya terhadap perkara yang berlaku menggambarkan bayangan seram pemimpin kerajaan cuba menyembunyikan kemungkaran di sebalik telunjuk sendiri.

Tidak mampu! Bahkan bertentangan dengan prinsip demokrasi negara.

Perspektif kerajaan adil tidak menepati kretirearnya selagi hak kebebasan rakyat bersuara masih diganggu-gugat dengan sekatan atau ugutan. Konsep 1Malaysia rakyat didahulukan, hanya sia-sia jika gagal mencipta satu dimensi baru secara keseluruhan buat rakyat.

Kalau Menteri di Jabatan Perdana Menteri, Dato' Seri Mohd Nazri Abdul Aziz, sendiri boleh berspekulatif, kematian mangsa berpunca dari terjun bangunan, kenapa tidak dibolehkan rakyat turut berspekulatif ia adalah dari kejahatan SPRM berdasarkan kaitan 'environment'.

Sebelum ini, beberapa orang penyokong Dato� Norza Zakaria, calon Majlis Tertinggi Umno telah membuat laporan polis bahawa mereka telah didera dan diseksa oleh SPRM semasa soal siasat dilakukan ke atas mereka berkaitan rasuah melibatkan Norza.

Justeru cadangan penubuhan Suruhanjaya Diraja bukan menjurus kepada satu aspek tragedi kematian Beng Hock, tetapi apa yang lebih jauh dari itu ialah tahap keintegritiannya terhadap sesuatu kes.

SPRM mula beroperasi secara rasmi pada 1 Januari 2009. Sebelum ini dikenali sebagai Badan Pencegah Rasuah (BPR) Malaysia. Ditubuhkan melalui penggubalan Akta Suruhanjaya Pencegahan Rasuah Malaysia 2008 (Akta 694).

Ia ditubuh bagi meningkatkan keberkesanan dan kecekapan dalam usaha pencegahan rasuah serta memperbaiki persepsi kebebasan dan ketelusan dalam pelaksanaan fungsi-fungsi suruhanjaya.

Sebaliknya hari ini SPRM dilihat gagal membuktikan peranannya menyebabkan ramai orang mempertikaikan kredibilitinya seolah-olah mengamalkan polisi 'double standard'.

Jika Beng Hock bersama Adun-Adun Pakatan yang lain SPRM boleh seagresif itu dalam menjalankan siasatannya, tetapi kenapa tidak terhadap beberapa pemimpin BN yang telah diketahui umum terlibat dalam penyalahgunaan kuasa dan rasuah bernilai jutaan ringgit?

Sebagaimana kes berlaku di Selangor sebelum pilihan raya umum 8 Mac 2008 melibatkan wang peruntukan Adun BN yang berjumlah RM500,000 dihabiskan dalam tempoh 50 hari merangkumi jumlah keseluruhan (54 Adun) sebanyak RM27 juta?

Dan kemana hilangnya aduan terhadap individu terbabit dengan skandal Zon Bebas Pelabuhan Klang (PKFZ) bernilai RM12.5 bilion, serta istana bekas Menteri Besar Selangor, Datuk Seri Khir Toyo, mencecah RM24 juta melebihi pendapatan asalnya di samping lawatannya ke Disneyland yang menelan belanja hampir RM1.8 juta.

Ringkasnya, ke mana pergi laporan demi laporan mengenai penyalahgunaan kuasa pemimpin BN tidak dipedulikan SPRM? Rakyat menuntut jawapan tegas tanpa sebarang unsur politik.

Kegagalan SPRM berbuat demikian bermakna SPRM telah mencalar polisi kebebasannya sendiri yang boleh dianggap penubuhannya adalah semata-mata untuk menjadi kuda tunggangan Umno-BN bagi melemahkan kerajaan Pakatan Rakyat.
